Daniel's Death Officially Ruled Accidental

A jury in the Bahamas investigating the death of Anna Nicole Smith's son Daniel has ruled it was caused by an accidental drug overdose, recommending no criminal charges be filed.

This verdict is huge because of what the jury didn't say -- that Howard K was responsible for the death.

The jury unanimously concluded Daniel died from "non-dependent drug use" -- meaning he wasn't addicted to what killed him.

3661. 3659. But we DO know that Stern allowed his name to be used to get Anna drugs, we DO know he administered drugs to Anna (by his own admission), we DO know he saw her "more impaired than that", and we DO know he kept a child from knowing who her father was after her mother died, we DO know he did not get re decent medical help for days while she was ill and then died.......those things are FACTS......judging him on just those things is enough IMO to quesion his actions.

How original of you to say this. I don;t think! How many times are these remarks going to be milked. Time for you antinoids to realise the authorative experts in the US and the Bahamas would also have done their homework. Guess what, no foul play recorded. No arrest or under suspicion for any wrong doing.

Daniel's inquest - accidental death. The list is endless. Surely, even the most simple minded person on this blog must have come to the conclusion, that if the Virgie team could have found out anything different than already reported, we would already know about it. Also, it would make a nonsense of Virgie vs Howard for defamation. She would be going for the big one Howard killed my daughter and grandson.

Why has she not done this! It's plainly obvious there is no evidence to support this claim, so she is stuck suing with a frivolous claim.

It is not illegal to use aliases for prescription drugs if you are famous. It is illegal to obtain drugs in your name and give them to an unsuspecting person. Police in both countries have already established all the drugs Anna used were prescribed for her personal use under different aliases, hence no law broken. You may not like this answer, but it is as it is.

Well, I never mentioned murder--simply stated FACTS---stern did every one of the things I mentioned and that is what I judge him on. I disagree with you about the law and allowing your name to be used for drugs meant for someone else---whether famous or not. I sure wouldnt want my kids to believe that there are people above the law. Maybe you feel differently, and that's your right.

Maybe Virgie is doing this to get the truth out about Dannielynn's family......if the things said about her family are not true, they could be very hurtful to her one day when she grows up and reads them. I think Virgie has every right to clear her name. just like anyone else would.......IMO

What you are saying is that there is one law for the famous and another one for the rest of us Americans. I don't believe you. Prove what you say with statues or laws. I think in this country all are under the same law. Therefore if Howard got drugs in his name to give to Anna then that should in my opinion be against the law. He stated in court if I remember right in the Seidlin court that no drugs for Anna was ever in his name or at least something to that effect not the exact wording but it meant the same thing. Prove that wasn't against the law to tell an untruth in court after being duly sworn to tell the truth the whole truth and nothing but the truth. Come on prove to me oh brilliant one.

3664. Although people often speak of "the statute of limitations", in fact there are many statutes which apply limitations periods to civil actions. Sometimes it can be difficult to keep track of the various statutes and their exceptions. Thus it is a very good idea for somebody who is concerned about losing their right to sue as a result of the expiration of the statutory limitations period to consult with a qualified lawyer, who can help determine which statute applies, and help preserve the right to recover damages.

The Discovery Rule
Sometimes it is not reasonably possible for a person to discover the cause of an injury, or even to know that an injury has occurred, until considerably after the act which causes the injury.

AMEN, AMEN, AMEN, AMEN, AMEN, AMEN, AMEN, AMEN, AMEN, AMEN, AMEN, AMEN, AMEN, AMEN, AMEN.

Virgies case was not important enough for a State Court, even McCabe realised this and the Federal Court will throw out this frivolous case. I am dumbfounded at the stupidity of O'Quinn's lawyers. This is going nowhere, is a waste of taxpayers money and once again downgrades the Virgie team's reputation, which was already in tatters. And then Virgie wonders why her reputation is damaged. Lady you did it to yourself with enormous help from John O'Quinn, Einy, Kerry, Mole and their ilk!

Tit for tat, mentioning bloggers in court cases, antinoids were and are infamous for their dafamation of Howard, Bonnie and Larry. They consistently blogged to find dirt on Larry and Howards family and failed abysmally. Antinoid posts recorded in court would put Virgies in the shade with their unfounded murderous comments!

Sorry folks VIRGIE cannot win!

Time for the antinoids to realise, they may SHOUT but it amounts to nothing. Sternies whisper and work in small numbers with concise and proven evidence. Numerous Antinoid people with crooked minds cannot overcome TRUTH, PROOF and EVIDENCE and it really angers them.

3670. He used an alias: A lawsuit on John Ritter's misdiagnosis
When actor John Ritter checked into a Burbank, California hospital the day he died, he used an alias, "Edwin Marcus," to protect his privacy. He died of an aortic tear, which might have been diagnosed by an X-ray. His widow, Amy Yasbeck, is suing two of the doctors who treated him, saying they misdiagnosed his condition, and did not order an X-ray. The doctors' attorneys say the name change created confusion at the hospital, for which John is responsible.

John Ritter was 54 years old when he died of an aortic tear in 2003. His widow is seeking $67 million in damages.

Advice: Patients using aliases, or their advocates, should carefully track their care against the hospital's checklist to ensure all necessary physician orders are performed.

3671. The thin line between legal and illegal drugs
December 27 2002

Pharmaceutical companies are streets ahead of delivering what geneticists promise - you just need the right supplier, writes Simon Castles.

There is a delicious moment in the 1989 teen flick Heathers where some concerned parents tell their daughter Veronica, played by young and rising star Winona Ryder, to stay away from prescription drugs.

If only Winona had listened to them. When picked up for shoplifting from Saks Fifth Avenue store in Beverly Hills last December, Ryder was in possession of eight types of prescription medication. Her funky handbag was a virtual pharmacy of painkillers and anti-anxiety drugs: Endocet, liquid Demerol, liquid diazepam, Vicoprofen, Vicodin, Percodan, Valium and morphine sulphate.

Clearly Winona, who made her name playing one depressed gen-Xer after another, is not in a particularly good way herself. The shoplifting and vandalism, and the excuses that followed - "I was preparing for a movie role; no, um, I thought the store was keeping my account open" - are symptomatic of much larger problems for Ryder. Reality does indeed bite.

But there is more to this story than just another 30-something struggling to keep pain and anxiety at bay. The way Ryder actually came to have such a list of prescription drugs in her handbag says a lot about the seedier side of the multi-billion-dollar pharmaceutical industry. It also raises questions about the thin line between the legal and illegal drugs industries, and the respective market and trade in both - a line that grows blurrier with each new wonder drug to hit the market.

According to Ryder's probation report, in a three-year period the star - using some half-a-dozen aliases - had 37 prescriptions filled by 30 different doctors. Apparently she was shopping doctors, the report said.

advertisement

advertisement

This shopping (as opposed to the five-finger kind she did at Saks) led her to Jules Mark Lusman, widely known as something of a doctor to the stars. According to the Medical Board of California, Lusman would charge thousands of dollars to make house calls to celebrities. He would examine the stars briefly, and then prescribe drugs, some of which were known to have addictive qualities.

Lusman - who is also alleged to have provided prescription drugs to another gen-X poster girl, Courtney Love - was said by the board to cater to the demands of wealthy and /or famous drug-seekers for prescription narcotics that would otherwise have to be obtained on the street. (Well, yes, one can't have the rich and famous getting their drugs from the street! That's where common, er, drug addicts are to be found.)

So here we have big money changing hands, cash and carry transactions, multiple aliases, multiple suppliers and the dispensing of a range of addictive drugs - and yet we are referring, remember, to the legal drugs trade, not the illegal one. Can anyone spot the difference?

But perhaps we shouldn't really be surprised by any of this. Is it any wonder the demand for prescription medication is growing at the same time as more and more drugs are coming on to the market - drugs that are increasingly capable of doing the most incredible things to our state of mind and body?

Take the popular antidepressants such as Prozac and Zoloft. They are a godsend to the clinically depressed, no question about that. But given that these drugs can have a positive effect on a person's self-esteem - can make an individual feel more outgoing and confident - might not others be tempted to take these drugs also?

In his groundbreaking book Listening to Prozac, psychiatrist Peter Kramer wonders if the new class of antidepressants has indeed opened the way for what he calls cosmetic pharmacology. In other words, it is quite possible that people will start taking such medication not because they really have to, but simply because it makes them feel better than good.

And what about the demand that may emerge in years ahead for the new wonder drug Modafinil? Ostensibly a drug for narcoleptics (that very small percentage of people who fall asleep uncontrollably), Modafinil is basically a wakefulness pill. So here's a hypothetical for you: how popular might such a drug prove to be to bright young things who want to work hard and play hard? In the fast new century, why waste time sleeping for eight hours a day?

Like it or not, we are at the dawn of a pharmacological revolution. In his book Our Posthuman Future, Francis Fukuyama puts it this way: "In the future, everything that the popular imagination envisions genetic engineering accomplishing is much more likely to be accomplished sooner through neuropharmacology."

So what will we do when a range of little pills can enhance intelligence, improve memory, help us concentrate better, make us more extroverted and immune to emotional pain? How will we manage the huge demand for such drugs? Who will get them and how? Will it be by legal means or otherwise?

These are big questions, and not ones Winona Ryder need try to answer. She is simply a troubled young woman who is doctor-shopping in order to get the best prescription drugs currently out there.

In another great little moment in Heathers, Ryder's character says wryly, "If you were happy every day of your life, you wouldn't be a human being, you'd be a game-show host." That may have been the case in the late '80s, Winona, but in the future we might all be as happy as game-show hosts - just so long as we can find the right drug, and a doctor who will prescribe it to us.
