Sambora Cops DUI Plea

Richie SamboraTMZ has learned Richie Sambora just plea bargained his DUI case. He pled no contest to driving with a blood alcohol level of .08 or higher. The driving under the influence charge was dismissed. And, prosecutors did NOT file child endangerment charges.

Sambora was popped for DUI last month. His 10-year-old daughter Ava was in the car at the time. We're told Sambora had a .13 blood alcohol level. Although the brass at the Laguna Beach Police Dept. recommended that prosecutors file child endangerment charges, we're told the rank and file cops felt the evidence didn't support the charge. Prosecutors agreed.

It's an interesting behind-the-scenes plea. Sambora got one of the most effective criminal defense lawyers in America on his side -- Blair Berk, who has repped scores of celebs, from Mel Gibson to Lindsay Lohan. The stars aligned in his favor, because prosecutor Dennis Conway is considered pretty fair and therefore didn't file child endangerment to get some PR. And Judge Craig Robison didn't do the whole "I'm so frickin' tough with celebrities" act.

Sambora will pay a $390 fine plus penalties -- total damage is around $1,600. He'll be placed on three years informal probation and must attend an alcohol education course. He cannot drink or do drugs during his probation.

It's not a matter of getting tuff because they are " stars" it's a matter of treating them just as anyone else would have been!
I don't blame anyone for getting the best lawyer they can afford and more power to them if that lawyer is real good, But not having child endangerment charges filed is just to much BS for me to believe

Only sure thing we can count on is that Sambora will not be able to stay sober for 3 years.

34. think oddsmakers in vegas want a piece of this action?! how soon til sambora drinks? taking all bets...! no, no,i'm sure he can stay sober for 3 years. and i'm sure they will find saddam's weapons of mass destruction and i will catch the tooth fairy, santa claus and the easter bunny! Are you KIDDING me? Any of us would have gotten a heftier fine, child endangerment charges, and possible jail time. It's not about PR or the like, it's about the LAW. Judges dont generally impose the letter of the law on someone for PR. They don;t need it and most don't want it.

36. I am sick to death of these idiot celebrities driving drunk and getting off with what amounts to a slap on the wrist. He could've killed someone! Now if I were Heather Locklear it would be a cold day in Hell before that moron would be able to take his daughter anywhere! Just because these celebrities have money they think the rules don't apply to them. Hire a damn chauffeur! Anyone who drives drunk should lose their license and be thrown in jail for a year. Yeah, people make mistakes, but I've never made one where countless other people could have been killed! It is just insane that those moron cops didn't charge him with child endangerment, because she sure as hell was in danger. Her own father could've killed her!!!

The part of the DUI - one can get.......... probation and alcohol classes.......no child endangerment charges is just wrong.........if it was Brittany Spears the media would have played it everyday, every magazine and she would have been charged.........the man needs help....i honestly don't think he gets it.....you can't go dry out for a week and be ok or social drink if you are an alcoholic. If something happens to Ava who is really responsible? and alcoholic or the judge who had the law to protect her but took an easy out?

39. COLOR ME SHOCKED! MY first drunk driving- 48 hrs jail. Alcohol school. 3 years probation, and $2500 fine, and years of suspended license until I paid the fine. Just don't get it.

40. In Arizona a convicted DUI is an automatic 10 days jail time. Oh, we don't have the celebs., I'm sure they would change that.
