Ex-49er Suing Ex-Wife for Golddigging

Joe Montana's softer side was sought out by NFL defenses for years -- turns out his ex-wife just sold it to the highest bidder ... in the form of old college love letters!

The former 49ers quarterback is suing his first wife, Kim Moses, and a Texas auction house for selling love letters and memorabilia from his time at the University of Notre Dame. The other items include Joe's freshman I.D. card, a University of Notre Dame letter of intent and Joe and Kim's 1979 marriage certificate.

Joe is suing in excess of $75,000 -- claiming the items were obtained and sold by Moses without his consent.

Moses' lawyers released this statement: "Ms. Moses is extremely disappointed by this lawsuit. The allegations in Mr. Montana's lawsuit are untrue. All of the items that are the subject of Mr. Montana's lawsuit belong to Ms. Moses, including property that she received from Mr. Montana as token of love and appreciation. The Property Settlement Agreement signed by them makes clear that the property at issue belongs to Ms. Moses."

Reps for Heritage told TMZ they have yet to see a copy of the lawsuit, but say "Ms. Moses warranted to Heritage that she had the right to sell [certain properties possessed during their marriage]."

Lawyers for Montana have yet to respond for comment.

do we have some control issues here ?

she's no longer part of the team nor in the huddle;

possession IS 9/10th of the law.

if these items were NOT identified within the
assets submitted to the courts, then the
possessor has every right to do as they please.

his best angle would to possibly get 50% of the proceeds.

or perhaps have first right of refusal at said purchase price.

don't forget, this is a guy who REFUSED to participate
in the 50 greatest players ceremony at the last superbowl
UNLESS he got paid an appearance fee.......

17. Montana is one of the nicest guys out there. I wouldn't want some greedy ex selling my stuff either. I met him when I was in 7th grade (is there a 7th grade theme going on here?) and he was amazing. Then again at a party as an adult. He is charming and sweet as is his wife. I hope he wins 50% of the profits and legal fees.

from pro football. What does that say about his character? I bet he's the one who need the extra money.

20. Joe Montana left this woman for wife #2 -- anyone who knows Joe's history knows of his womanizing. If he was so concerned with this sort of "stuff," he should have taken it with him when he left her. Why would his kids from wife #3 (he never had any kids with the first two wifes) want these love letters from their father to his first wife? Give me a break, Joe, and get over it. Those items are hers to do with as she pleases and she pleases to sell them!!!

21. Kim doesn't need the money. She is the executive producer of the tv show Ghost Whisperer. Her motivation is unclear, but it certainly wasn't for financial reasons.

22. did you forget the long writers strike that just happend? obviously she thought this would help get her through the tough times....plus if you saw those jennifer love hewit bikini shots you know that's not going to be paying the bills for much longer. Homegirl ex-mrs. montana probably thought she had to score the extra cash where she could, either that or she is just that money grubbing and pathetic!!

23. kim is one of the most successful indy producer's in television. her show, the ghost whisperer on cbs is the highest rated show on friday nights and one in a long line of successful shows. the headline of tihs aritcle is so unfair and is a reflection of our society and i find the people who are sniping to be sad. she had a box of stuff sitting in her garage for 30 years collecting dust and there are people out there who actually value this stuff. that's the sad part really, isn't it? it's trivial and she certainly doesn't need the dough. we should all just laugh at joe's response and move on and recognize a powerful and succesful woman. you go girl.

24. I always liked Joe until he kicked the Cincinatti Bengals ass 2 times in the Superbowl. Lets face it we lost because of the way their punter punted. I never have seen any thing like that since!!!! First time we were at the goal line and big Pete, (I think that was his name) how could I forget?) was given the ball 3 times from Kenny Anderson are quaterback at that time. He just coudnt polw his way in. I still dont know what the big deal is Joe. U are worth millions$$$$$, what do u think she has? Grow up Joe!

25. Many of the comments here are appauling! Comment boxes and forums on these sites truly bring the morons out of the woodwork to sound off on something they have no business talking about.

Its obvious many of the commenters here know nothing about the woman involved yet they feel empowered to start name-calling and slandering her as a golddigger? Tacky and fouler than foul!

It is horrible when good people get their names dragged through the mud, so the peanut gallery can feel better about themselves. If what an above poster said was true that she's responsible for the Ghost Whisperer, why they hell would she need money over dusty momentos? Think people.

This is a sad and pathetic lawsuit, and it says a lot not only about the sad cretins insulting the woman involved, but the individual behind the lawsuit as well. I hope this case is thrown out of court as a joke.

26. After supporting Joe for years including in their marriage Joe walked out on Kim and didn't speak to her for 30 years. She doesn't need money and didn't need this stuff taking up space in her home. It stood to reason that it had no value to her, but might to a Montana fan. If Joe had a concern, all he needed to do was ask for or buy it back. End of issue and no story. By pursuing a lawsuit, it shows once again an athlete can be a winner on the field and a loser off of it.
