Nick Hogan Gets Eight Months in the Slammer

Nick Hogan threw himself at the mercy of the judge today in Clearwater, FL in his felony reckless driving case -- and he got just a lil' bit. Hogan was sentenced to eight months in jail, five years' probation and 500 hours community service, and the judge yanked his license for three years.


His victim -- and once best bud -- John Graziano's family had asked for a year in the slammer, but the judge didn't go quite that far. Nick apologized to the family in his statement, which, according to the Grazianos, would've been the first time he'd ever done so.

John's sister and girlfriend gave particularly heart-wrenching testimony -- the latter told the judge how she had to feed him and how they have to watch movies together in the comfort ... of his hospital bed.

UPDATE 3:49 ET: And it looks like they're taking him away. No reaction at all from Nick.

UPDATE 3:47 ET: And here's the sentence ... EIGHT MONTHS IN PINELLAS COUNTY JAIL, STARTING RIGHT NOW. Nick was totally expressionless.

Judge withholds adjudication!!! But judge points out that sorry ain't the hardest word here ...

Judge yanks his driver's license for three years. And no drinkin' -- but as the judge points out, he's not 21, and won't be for over three years.

Here we go: Five years probation, 100 hours of community service per year, one full day in "some positive framework" every month. Sounds a lot less when you put it that way.

Judge Federico says this wasn't "an accident" and that Nick's driving behavior was "cavalier." Not looking good for Nick, if he's reading the judicial tea leaves.

UPDATE 3:27 ET: We're through with statements and evidence. Now we await the judge's decision, and we're getting a lil' judicial headscratching, literally...

Weinberg says that Nick's being sued for more money than the Hogan family has. Weinberg says that this is like two sons getting into a car accident together, and asks the judge not to adjudicate. And, finally, he's done.

Slightly superfluous Latin legal jargon update: Weinberg keeps saying "nolo" to refer to the plea, as in "nolo contendere," which translates into, roughly, "I do not wish to contest."

He just said Nick "lost" the companionship of his best friend. Attention: John's not dead!

Nick turns to the Grazianos and apologizes to them, and says he "loved John to death" and that he hasn't driven since August 26, 2007, the night of the crash.

Sean Schumura runs The National Wave, a charity for which Hulk -- as it so happens -- is the spokesmeathead. He says Nick worked for them, and -- chamber music claps -- didn't take his $150 per day stipend.

Nick's mom gets up ... and that's a wedding ring on her left hand!!! Uh, what? (Linda and Hulk are in the middle of a nuclear divorce -- she filed last November.) She says Nick "never meant" to hurt John.

The Hulk -- Terry Bollea's his real name -- steps up: He repeats that John G. was "like a son" and that they went on family trips. Hulk says they sent John PowerBars to Iraq.

John's mom says, quite eloquently, "I'm not seeking revenge, only justice." And the family and state's witnesses are done.

Amazing -- the mom is totally holding it together in front of the judge! John's mom Debra Graziano quite resolutely that Nick doesn't seem apologetic -- and begs the judge to find Nick guilty.

Nick is an idiot, part 879: Ashley says that Nick's license plate COEHSP stands for "Capable of Eluding High Speed Pursuit." Not anymore.

UPDATE 2:27 ET:
Ashley Berry, John's girlfriend, is speaking -- trying her best to, at least. She says they were together for seven years. She describes having to watch a movie with him in his hospital bed -- and not knowing if he can hear or understand anything.

UPDATE 2:25 ET:
Now up, John's sister Christian Carson. She says that sometimes she tries to call him, and breaks down when she realizes she can't. Tough. And she says that Nick has never apologized for the crash.

UPDATE 2:21 ET:
Ed Graziano says that Hulk and Linda haven't been there for John, now or even before, even though they claim he was like a "brother" to Nick. Ed asks the judge to throw the book at him.

UPDATE 2:18 ET:
And Ed Graziano continues, saying that he spends 10 hours a day at the hospital with John, and that John will spend the rest of his life with mental and physical disabilities. Hulk is peering over at the Graziano family. Ed says that when Nick went to the hospital to see John, he looked totally bored, and even shot dart guns and skateboarded around the hospital! OMG!

UPDATE 2:14 ET:
Prepare for waterworks ... here's the victim's dad, Ed Graziano. He tells the judge about John's decorated service in the Marines. And he says, "What al Qaeda couldn't do to my son, Nick did in a matter of minutes."

UPDATE 2:12 ET:
The State wants Nick to admit that this wasn't an accident. Moreover, the prosecution -- through the family -- wants him to do 5 years of probation and 500 hours of community service,

UPDATE 2:09 ET:
Rosenwasser shows the judge the twisted remains of the yellow Supra, and says that Nick's speed on that fateful night was "totally unacceptable," especially given Nick's driving record.

UPDATE 2:03 ET:
We're told that they're watching post-crash video as well as "very graphic" footage of Nick's buddy John Graziano right after the accident. Nick's face tells the story too.

The judge, Nick, and his lawyers are watching a videotape.

UPDATE 1:55 ET: The plea of no contest is entered.
Now, the tough part -- the judge will listen to testimony and look at evidence to make a decision on Nick's actual sentence.

And here comes the big plea -- 17-year-old Nick raises his hand, says he's a literate human being with a GED, not under the influence of booze or drugs, is OK with his lawyer, blah blah blah ... and is about to plea no contest with a year of county jail and five years of probation.

: There's a book called "The Power of Now" in front of Hulk -- it's called "A Guide to Spiritual Enlightenment" and it's by Eckhard Tolle. Nick looks like he'll need some of that.

: Nick's lawyer asks the court if Nick can do any probation in California -- there doesn't seem to be any objection from the judge or the state of Florida.

: The Hulkster is praying, and his wife keeps looking over at the Grazianos. Awkward city. The lawyers are conferring with Nick and Hulk as to what he would do.

UPDATE 1:38 ET
: Nick's lawyer seems to be simpatico with up to a year of jail time, and then some form of probation up to five years, and a no contest plea.

UPDATE 1:36 ET
: The State says that the victim's family -- the Grazianos -- are asking for a year's jail sentence, and that's what they are asking for.

: Here's Your Honor, Judge Philip Federico -- all rise.

: And there's Nick, and sister Brooke. Nick's wearing a gray suit, and Brooke -- well, she's got bare shoulders. We're told the entire Graziano family is in the house on the other side as well. Uncomfortable to say the least.

It has not been proven that John Graziano did not have a set belt on it's only hearsay at this point , It will be shown that John did have a set belt on at the cival case, I believe that Nick didn't get the time he should have in this case which should have been 2 years because the mother of John is taking money from the Hogans and it's going to hurt the civil case also which means that's less money to take care of John for the rest of his exsistence ( not life ) she need to stop as we have seen by her taking this money which the Hogans lawyers are telling him to do he will get away with millions in the cival case the judge that apointed her as guardian of John should be shot !!!!!

542. No one made that boy get in the car with Nick. If they were such great friends and "brothers" then he knew BEFORE he got in the car with Nick that Nick had a thing for speed. Anything could happen, obviously, and it could have been anyone in that passenger seat. I'm not sayin Nick wasn't wrong for what he did, but I'm pretty sure a gun wasn't put to John's head forcing him to ride.

543. I think it is very sad for both families. I hope the young man does get better. I don't see it as a "picnic" for anyone. Hulk's son should have never have had his license to drive to begin with. He was too young and immature. Now everyone involved, is paying for his immaturity.

IT HAS NOT BEEN PROVEN THAT GRAZIANO DID NOT HAVE A SEATBELT ON I EM SURE THAT HIS ATTORNEYS WILL BRING IN EXPERTS TO PROVE THIS THE SAD THING ABOUT THIS WHOLE CASE IS THE MOTHER OF GRAZIANO TAKING MONEY OR GETTING PAYED OFF AT HER SON'S EXSPENCE OTHER WISE NICK WOULD HAVE GOTTEN AT LEAST 2 YEARS

545. People are Human...Nick is no diffrent, I watch Hogan Knows Best..I think his parents do a good job of raising their kids. Nick is young and thing happen in our life..the unfor seen. Nick friend knew what type of lif style he would be living being Nick friend and we all take risk in life. This parents of the injured man is being unfair. I am sure his friend forgives Nick why cant they. I raise my sons 17yrs old and 14yrs old by myself for the past 17yrs. All we as parents can do is pray and wish our children make the right choices in life. NO ONE IS PERFECT. I feel Nick is going through alot in his life with his family Private Matters..Mr. Hogan said this whole thing as torn his family apart..NO...NO WAY...only our choice and life style can do that. To Nick Hogan this is Life if noone has told you this.it happens....MUCH WORSE CAN AND COULD HAVE HAPPEND IN OUR LIFE. we just have t be careful of our choices. I have over 50 kids I call my babyboys and babygirls in Las Vegas that really have a hard life, they all come to me for advice, and a PEACE..PEACE OF MIND..when they can no truen to the parents..whenever we are do talking they turn to their Parents and their Life is a PEACE... 547. The Hogan family is just off the chart crazy. They are not sorry and Nick asked his dad to sign a deal with a tv show so the minute he gets out of jail they are there. Nick is a spoiled little rich kid brat. He should of got more time in jail. At least when Nick get out he can still have some short life, unlike his friend! The Hogans suck!!!!

548. This young man is an example of what results you can get when giving your kid everything. That being said, he is a kid and while the decision to jail him for 8 months is just, putting him in solitary is enough to make anyone who thinks they will spend 8 months with nothing to do in an empty room go totally nuts. While a spoiled bat, he is not a hardened criminal. It seems to me that putting him in a cell with 3 other juvenile offenders is a better alternative....unless of course you are trying to force the kid to suicide. I don't however think he should be alowed to drive for a lot longer than three years.....maybe 7-10. And some sort of mandatory treatment for selfish,Hedonistic behaviour should be mandatory for years as should some sort of community service that involves both those who are the offenders and those who have suffered by the hand of the offenders.. And that community service should go on for years.

551. That guys family is only out for the money. They know damn well they want revenge, which is ridiculous, what Al Quida couldnt do to their kid, he did to himself getting in the car. And of course it was a accident, and I dont beleive for one minute he hasnt said he was sorry. Come on, thats bs. They should be mad at their kid, not Nick, I am sure that J was egging him on and telling him to go faster, he was older and supposedly more mature because he was in the service?..His dad saying that makes me wanna puke. Try being a little bit more dramatic. Be mad at your son, not Nick. Their is no victim here, just stupid kids making stupid decisions. There should have been no jail time, he should have not been able to drive for a long time, probabtion, and 1/2 medical expenses, because it was the other guys fault too. You know he probably wasnt wearing a seat belt, but that family seems like they will try to bury that info. They talk about how bad the Hogans are, they seem a lot worse. It wasnt an accident?...Good God. That is just sickening, They know damn well it was, they just want the MONEY!!!!!!!!!!!

552. DID THEIR MONEY BUY OFF THE COURT when there is no jail time and should damn well be? John's family is again being compromised and Nick is getting off too easy. Oh, good, he will go to jail for 8 months .. it should be a lot longer for he is reckless and a rich bum.
