Farina Booked on Felony

TMZ has learned Dennis Farina is being booked on felony weapons possession charges.

As we first reported, Farina was busted at LAX this morning after airport security saw he was carrying a loaded .22 caliber pistol in his briefcase at a security checkpoint. We're told cops decided to change the booking from misdemeanor to felony after they determined the gun was not registered. Prosecutors could eventually charge him with either a misdemeanor or felony.

Farina is being held on $25,000 bail. He's still in custody.

32. I love it when people come to places like this and talk completely out of their ass. You jail house lawyers are cracking me up! "This is a federal crime and it out of Californias jurisdiction", " Hes a retired cop and can carry a gun anywhere", "If he wasnt an actor they wouldnt have arrested him". STFU!! Really, STFU. Non of you know what the hell your talking about!

First off, it is California's Jurisdiction and not FBI. FBI would handle the case if a federal offense occurred. They respond incase a federal offense occurred. Because it was only a firearm in a bag at screening, 12025PC of the California Penal Code is the violation. If it is at screening it never makes it into the sterile area and therefore it is simply carrying a concealed weapon. PERIOD. Thats it. Nothing more. Nothing less. It is what it is and there is ZERO leeway. People get arrested for knives they bought while on vacation, belt buckles that resemble brass knuckles. The law no longer allows officer discretion for these violations at screening. Several people a week get arrested at LAX for the same offense. It happens. Old people, young people. Its all the same. Katt Williams was arrested about 6 or 8 months ago for the same offense.

Second, Just because he is a retired cop does not mean that he has a CCW permit to carry. Police departments require alot of their retired cops in order to maintain a CCW. Most agencies require a yearly qualification with a firearm. When a guy retires and leaves the area, he most likely wont return annually to qualify.

Finally, if you didnt catch it before and you were one of the idiots that opened your pie hole not knowing what the hell you were talking about, get a clue. Buy a vowel. What ever it takes for you to STFU!

33. COPPER, COPPER - IF I had a farm to bet, my guess is.... Because he did violate the law (somewhat) - Airport Security HAD to follow procedures for Homeland Security srutiny.

HOWEVER, phone calls were made, deals are in the make probably as I type. This will be reduced to a misdemeanor by tomorrow if not by weeks end.

AND THEN...... Being he probably has no PRIORS of a felony, not sure if he has a record at all - but, I GUESSING the case will be swept under the carpet with fines.

p.s. I'm not a jail house lawyer - I'm a graduate of "Court TV" of old.

34. If the cops had serched better they would have found another dead weapon between his ears. In todays world only the terminally stupid take weapons to airports.

35. I agree with you Bill.

He forgets where he stores his "unregistered" weapons???

My question is...... How many other weapons might he and/or have that he "conveniently" forgot about?

How old is he? Should age be considered to have a liscense to own a weapon just like a drivers liscense? LOL i'm just messing with the old guy, he looks fantastic for his age.

36. Bill, good comment! I know a few retired cops and none of them carry a 22 as their personal weapon, most have a handgun very similar to the one they carried as an officer. It is not a requirement that guns be registered, but I believe all states require that to carry a concealed deadly weapon you must be licensed. Beyond the background check for this license you have to prove in some way that you know and understand basic gun safety rules. Some states waiver the more stringent reqirements for retired military personnel an retired cops. No one who spent a career in law enforcement or the military is stupid enough to forget they have a weapon on or with them and certanily they they know of the increased security in airports. Had he taken an officer of TSA aside and told them he had a weapon it might have been confiscated but he would not have been in the trouble he is now in. The only thing that might save him is that the courts in California are modeled after the ones in OZ so he will probably get off with 85 minutes in jail.

37. I believe this case is going to be more of "We need to get the message across", If this case goes to a jury trial, he will never be convicted.. Before any of you go off the deep end as per, he's an actor and going to get off because of his popularity.. Naw, quite simple.. He drove in from Arizona, "as per his statement", he may well not have to have the gun licensed in Arizona, especially since it is a .22.. Someone ask, what can a .22 do for protection, trust me.. it can be very lethal.. This may well be nothing more than his forgetting the weapon was there. He is an excop, carring a gun with him everywhere he goes is normal.. Ask any other cop that happens to come online to chat and give opinions. Problem is, his forgetfulness wouldn't make it past the SCANNERS, they didn't just happen to check his luggage, it was SCANNED, and the gun showed up.. Never know, LA District Attorney might well be up for re-election and this gives his office free publicity..

43. The alleged reporting on this case makes no sense!
1. Since there's no gun registration in either Arizona or California, it can't be an unregistered gun.
2. Farina is not a retired Chicago cop, he's a former Chicago cop. He worked the 18th District [Near North Side] on the paddy wagon [squadrol in CPD jargon].
Big difference!
He served only 19 years, it takes at least 20 years to retire, Farina left early because the movie & TV money was so good, it overrode the need for the pension.
3. I;m in total agreement with the earlier post about carrying a .22. When Farina was a cop, they carried .38s. Only The Outfit guys carry those & then only to do the actual hit. A .22 is just about the only handgun that can have a silencer attached to it & not jam because of that. It sounds like Farina was imitating the idiots he used to arrest, unless he was one of the many Chicago cops that hung around The Outfit crews.

44. First off, your talking out of your ass again people. There is a law in California regarding a gun registration. It is illegal to be in possession of an unregistered firearm. The charges will not be dropped. Has nothing to do with th DA election, it has to do with the law. A Plea deal may be reached, but if he was in possession of an unregistered firearm, concealed at a screening station, he is busted. LA District Attorneys have filed cases against many people for the same offense. People, in the field it is not the officers responsibility to determine intent. There is ZERO officer discretion. If you conceal a firearm, you go to jail. LAX PD probably arrests somewhere close to 100 people a year for this specific offense. What the DA does with it is up to them, but the ALL get filed. Also, the DA has nothing to do with the arrest and booking, therefore it wouldnt matter whether he was up for election or not at the time of the arrest

45. This is what's wrong with the racist justice system. They have to decide - either it's a felony or not. If it is a felony - that's what he should be charged with. What's to decide - if it is illegal to carry an unregistered weapon, ESPECIALLY at an airport.
