Quaid to FDA: Mind Your Own Business!

Hell hath no fury like a father scorned!


After Dennis Quaids' newborn twins were mistakenly given a massive overdose of a blood thinner last November, they sued the drug's manufacturer, Baxter Healthcare Corp., claiming the label on the bottle contributed to the foul-up. Baxter says it's not their problem because the FDA approved it, and they're trying to back out of the lawsuit on a technicality.

Now he's testifying on Capitol Hill today, hoping to prevent other drug companies from weaseling out of similar lawsuits.

17. You go Dennis! I am so proud to see a parent stand up for their child. What a lot of people don't realize is the work he is doing today will literally save thousands of lives in the future. Keep up the good work Dennis and have fun with those gorgeous kids!

What's that?.....you took Paxil and your kid is deformed....OOPSIE...didn't know it was gonna do that. What's that?....you took Bextra and had strokes and a heartattack.....OOPSIE...didn't know it was gonna do that. 20. The Food and Drug Administration has a record of catering to the drug companies
more than heading the interests of patents. Obviously since drug companies set a lot of
advertisement in the televised media, it is less than a suprise that the TV media will
investigate the drug companies nor their friend the FDA. With more and more emphasis
of celebrity worship and coverage by the press, it is inevitable that they will cover this,
albeit very little. What happened with Dennis Quaid's twins was not the first time that this has happened, but unfortunatly it takes a celebrity who had this unfortunate tragedy happen
to their children to bring this crisis to the public.

23. I agree with the need for a label change, but the person administering the drug needs to check the label as well. They shouldn't just be pulling things off the shelf assuming it's the correct med.

24. Why is he suing the drug manufacturer?! Why not sue the hospital?! They're supposed to stop and take the time to read the labels on things before giving them to patients, THEY messed up, THEY should be sued.

25. The FDA holds a significant amount of the blame here. After these Heparin accidents started to occur Baxter WANTED to change the labels but are legally bound to use the ones that were approved by the FDA while they go through the label approval process again -- a process that takes a several months to a year to complete. Red tape and bureaucracy are to blame...oh yeah and stupid nurses.

27. This is an important issue, folks. Conservative or liberal, as Americans we should not lose our right to have our case tried in a local court by a jury of our peers. We need to take back our rights and fight against preemption.

28. If you clowns did some research or were a little more "aware" you would know that the Bush Government is using little known loopholes to keep people from suing corporations (read "billionaires"). Stick with what you do best children...

In this case, the company, Baxter Healthcare Corp., is seeking to use the doctrine of preemption to shield it from any civil liability, claiming that once FDA approved the labeling and packaging at issue in the case, the company is immune from civil suits for money damages. Why should they get a free pass?

Faced with an unfriendly Congress, the Bush administration has found another, quieter way to make it more difficult for consumers to sue businesses over faulty products. It's rewriting the bureaucratic rulebook. The Bush administration is attempting to use federal regulation to curtail lawsuits and give complete immunity to corporations who are negligent and harm Americans.

I hate frivilous lawsuits. However, this will do nothing to curtail such actions. This simply denies Americans their day in court.
