Cruise Lawyers Spank Baby Store for Babbling

In a move totally out of character, Tom Cruise has sicked his lawyers on luxury baby boutique Petit Tresor, accusing them of babbling to the tabs about Suri's outrageously expensive designer Scientoloduds.

According to the cease and desist letter sent by Cruise's law firm, the store leaked false info that Suri's parents dropped a cool $350 - $400K on the tot's wardrobe over the last two years. Tom and Katie's mouthpieces claim the store violated their clients' right of privacy.

The lawyers are asking the store to, "not say anything (whether true or false) about Mr. Cruise and Ms. Holmes' shopping habits."

When TMZ spoke to Petit's Andy Behrman all we got was, "Are we allowed to comment?"

91. I'm with Tom on this one. When you shop at a high end store you expect certain things and one of them is privacy. I have seen this store use Tom and Katie for their own publicity purposes since Suri was born. Immedatelty they were showing items that the said were bought by Tom and Katie for Suri on national TV . They even spilled the beans on Tom and Katie's private page , which had a special password only access for family and friends to shop for gifts for Suri on their website. I found this spilling of the bean very tacky and unprofessional then and even more so now as the store has continued to talk about Tom and Katie.

93. I think Tom should start spending some of his "big" shopping money on "gold-diamond" sippy cups for their sad toddler. Suri's and Katie's sad eyes say it all. Sorry Katie, you can run, but you can't hide because Tom is in charge of everything and everyone.

I'm SO sick of this "pretend" family. Tom, a word of advice to you, open the closet door and just come out!

The letter to the store from Tom and Katie's attorney (and that's attorney singular) was polite and simply made a request that they not do this sort of thing. It was not a cease and desist letter, as reported because there was no threat of action. The store's response was to submit the letter to TMZ in an effort to disparage Tom and Katie. And this is supposed to be a high end store. A real high end store would never do such a thing and would value any customer.

You could not be more wrong. As an attorney who has drafted such correspondence on many occasions (though never one as poorly constructed as the one at issue), I can tell you the letter is UNEQUIVOCALLY a cease and desist letter. It need not threaten legal action, it need only state the behavior which it claims to be a violation of of a client's rights and demand that such behavior cease. In this instance, it does not threaten suit because the attorney knows that his client not only has no legal leg on which to stand, but is also a man who should (in my opinion) be committed to a mental health facility for his own good and the good of his poor ,impressiobale daughter. Tom Cruise is acting in the manner of a bullying loon.

I don't care how often the store speaks about its clients. Apparently it never bothered the Cruise family in the past since Suri is past two years old and they are STILL shopping there. So long as it is not disclosing information that puts someone at risk (address, phone number, credit card info, travel patterns) , it has EVERY right to speak in the absence of a confidentiality agreement. Absent contract, THERE IS NO RIGHT OF PRIVACY BETWEEN A SALESCLERK AND A CUSTOMER!!! Moreover, as Tom's attorney well knows, so long as his clients aggressively and routinely SEEK publicty by ALERTING the press each time they patronize a public restaurant or shop at a public store, they have NO basis to contend that said store's confirmation that they are in fact customers in any way violates Tom's right of publicity. To have the temerity to flatly DEMAND that someone NEVER mention Tom and Katie's names, EVEN in TRUE statements, is the height of arrogance and utter gall. Even a first year law student recognizes the completely ridiculous and unenforceable nature of such a demand.

The actual letter says "We hereby request that you no longer use our clients as part of your public relations and marketing efforts." and "Please do not say anything (whether true or false) about Mr Cruise's..." and "Thank you for your cooperation."

If you think that is a DEMAND, wow. Yet you believe you know enough about Tom to have him committed, though you don't know him personally nor likely ever met him. Contrast that opinion with the legions of praises from those that actually know Tom and have worked with him (e.g., Will Smith, Dustin Hoffman, Penelope Cruz, Sidney Pollock, Zellweger, Robert Redford, Ben Stiller, Jamie Fox, etc.).
