Hogans Got Hang Ups on Phone Calls

TMZ has learned that lawyers for Nick Hogan, aka Nick Bollea, have asked a judge to stop Pinellas County, Fla. Sheriff Jim Coats from releasing any more recorded jail phone calls. Hung up on you!

Tapes of Hogan, currently serving time for a horrific car accident that gravely injured his friend, were released to the media by the Sheriff. Hogan and his family claim the release of these conversations violate their privacy -- even though you can hear a recorded voice on the tapes telling you, what else, that the call is being recorded.

A Sheriff's Department spokesperson tells us they won't hand out any more tapes until a judge makes a final ruling.

46. It might say the calls are being recorded but it doesn't say that "we might broadcast them to the world".
Leave them alone they are great people! Hogan has done a lot of things for their community here in Florida, many things you don't hear about. How about checking some of them out TMZ and report on some of the good.

FOIA carries a presumption of disclosure; the burden is on the government - not the public - to substantiate why information may not be released. Upon written request, agencies of the United States government are required to disclose those records, unless they can be lawfully withheld from disclosure under one of nine specific exemptions in the FOIA. This right of access is ultimately enforceable in federal court.

FOIA only applies to Federal agencies. Nick is in a county jail. And while I think this kid is a slimebag I am very surprised that they are allowed to release the recording s to the media.

49. Jail house phone calls are considered public record if you are not talking to your lawyer. If you are sentenced to jail or prison then you give up your right to privacy in some respects...this is one of them. It's just nice to see the 'real' side of this person. He doesn't care at all for his friend who is now a vegetable for life due to his illegal street racing and the 140mph he was going when he lost control of his vehicle. Also, The sheriff did not sell these tapes, the news media requested them via the freedom of information act. You can request anyones phone calls from jail if you want to, you just need to fill out a foi request and it's done.

53. To Kevin #47. It is the responsibility of the driver, that was Nick, to ensure the passenger wears a seatbelt. Nick is responsible if John didn't wear it.

55. I am by no means a "hogan" fan. I think this kid should just do his time and shut up. His family should do the same thing.

That said, I read in this blog that anyone can request the tapes under the Freedon of Information Act. If this is true, these people should fire their lawyers. These people have no sense, so they need a lawyer who does have sense. Any person with the intelligence if a half-wit would know that it would be newsworthy re request those tapes. Really their lawyer should have prevented this by telling these stupid people to shut up at the jail or to block this in advance. I bet the legal team is being paid a lot of money, too. I'd fire those attorneys.

58. Again FOIA only applies to Federal agencies, not county governments. Additionally Nick is a minor which gives him some rights that adult offenders may not have. Florida does have an open records law, but I have never heard of inmates phone calls being part of the public record. Even in states that have open records laws you can't get whatever information you want. You can't for example, release a prisoner's medical files to the general public. It would surprise me very much if prisoner's phone calls were considered part of the public record in Florida. Particularly if those phone calls are personal and involve family members. After all, even though Nick has been convicted of a crime, his parents have not, so they do have some limited expectation of privacy- i.e. their conversations with their son will not be released to the media. And while it's true that on some level the damage has been done, if the sheriff has violated the law by releasing the tapes it is likely that they will not be able to be used in the civil suit. Bad for the family of John Graziano, but good for the Hogans, because those tapes would have been very detrimental and surely would have drastically upped whatever award a jury might give.
