Devo to McD's -- We'll Whip You, Whip You Good!

Devo -- yep, as in '80s Bar Mitzvah stalwart Devo -- is red hot over a McDonald's Happy Meal toy that they say co-opts their most famous get-up.

The New-Wave band is whippin' mad over "New Wave Nigel," (left) a lil' singer guy who clearly wears one of their concentric "Energy Dome" hats. On their website, the Devo boys call the toy an "unbelievable rip-off."

The fast food behemoth had no comment as yet.

UPDATE: Devo's lawyer tells TMZ that there isn't any lawsuit being filed -- and there won't be. The matter has been "amicably resolved on mutually agreeable terms." The lawyer did not indicate whether she too wore an Energy Dome during billable hours.

16. Doesn't McDonald's sue every time they think some little someone is infringing on their trademark/likeness? Should be o.k. to get sued as well as to sue!

18. what about the 2 characters in the movie "revenge of the nerds" they dressed in yellow "nuke suits" playing hand held "synthesizers" pretending to be "devo" on a stage at the frat carnival. did the band do anything about those costumes in that scene back then?....NO! they're right ! and they should'nt be ripped off!......so start paying back those residuals and copyrights mcD's !

21. when i first saw this figure, i assumed devo had licensed their image to mcdonalds. i am pleased to learn they are cooler than that and i hope the band sues.

22. I don't see how they have a case at all. Did they Trademark the hat and glasses, i bet not? Do the little plastic figures play shotty Devo music? If not they have no case.

24. Devo is still alive and making money, they don't NEED McDonalds to give them publicity and I very much doubt this is a publicity stunt since it appears to have already been resolved.
Whether you like McDonalds, Devo, American Idol, or not, the fact remains that it is a copyright infringement and big corporate giants like McDonalds shouldn't have immunity against this.
It's a blatant ripoff, and I'm very glad someone stood up to McDonalds.
