Ed to Cedars: You Abused Me

Ed McMahon is suing Cedars-Sinai Medical Center in Los Angeles and billionaire Robert Day for his slip and fall at Day's house, which resulted in Ed's broken neck. He's claiming, among other things, malpractice and elder abuse. And he says Cedars made him feel like "a bobble head."

In 2007, McMahon went to Day's home, slipped on what he calls "unsafe entry stairs," reached for non-existent hand rails, fell and broke his neck.

He was taken to Cedars, and in a lawsuit filed today in L.A. County Superior Court, claims the docs "failed to take an X-ray of McMahon's cervical spine, in spite of his complaints of severe neck pain." McMahon claims he was released by Cedars with a broken neck when he should have been treated.

Two weeks later, McMahon's doc finally X-rayed Johnny's sidekick and discovered the problem.

McMahon's suit says he was so given the bum's rush in and out of Cedars that "he felt like a bobble head."

As for the elder abuse claim, the lawsuit alleges elderly patients are prone to these injuries and Cedars should have been heads up.

Day, by the way, is the founder of the TCW Group, an investment management firm. The firm handles $130 billion in assets.

McMahon's rep, Howard Bragman, says, "We had hoped to avoid a lawsuit, but our discussions were not fruitful and we were left with no other options. That being said, we believe our suit has great merit and we expect a favorable resolution."

McMahon is suing for unspecified damages. Calls to Cedars were not immediately returned.

33. Sorry Ed, but you cannot sue for lack of grab bars at a private residence!!!! Handrails are "required" at commercial, multi-family and government buildings only.

34. It's legal action like this that makes hospitals charge more money for less services. He probably won't collect for the, "unsafe entry stairs" because stairs are usually checked by an inspector before a building is given a certificate of occupancy. That leaves the hospital who was negligent in Ed's expert medical opinion. Not only were they negligent, they abuse the elderly. C'mon, you can't sell the house to pay the bills so you sue the hospital and play the pity card in a neck brace.

37. You would think that if Ed McMahon was close enough to Robert Day to be a guest at his house, the guy could help him out a little. For a billionaire to throw someone a million or 2 is like me giving one of my kids $5, like pocket change. I wonder why no one is even talking about that.

It's rather sad but it's not the hospitals responsibility to bail Ed out, It's Ed's responsibility to dry out.

44. SO WHAT IF ED WAS HAVING A DRINK!! I only hope at 85 years of age, I'm able to go out and about and have a few drinks at a party. So he had one too many and fell. Give me a break, the guys 85. The billionaire Day should have looked out of Ed. Even if I hated someone, if you take a fall at my house and it puts you in financial difficulty because you can't work, and I've got billions of dollars, I'll throw you a bone to help you get on your feet.
