Ed to Cedars: You Abused Me

Ed McMahon is suing Cedars-Sinai Medical Center in Los Angeles and billionaire Robert Day for his slip and fall at Day's house, which resulted in Ed's broken neck. He's claiming, among other things, malpractice and elder abuse. And he says Cedars made him feel like "a bobble head."

In 2007, McMahon went to Day's home, slipped on what he calls "unsafe entry stairs," reached for non-existent hand rails, fell and broke his neck.

He was taken to Cedars, and in a lawsuit filed today in L.A. County Superior Court, claims the docs "failed to take an X-ray of McMahon's cervical spine, in spite of his complaints of severe neck pain." McMahon claims he was released by Cedars with a broken neck when he should have been treated.

Two weeks later, McMahon's doc finally X-rayed Johnny's sidekick and discovered the problem.

McMahon's suit says he was so given the bum's rush in and out of Cedars that "he felt like a bobble head."

As for the elder abuse claim, the lawsuit alleges elderly patients are prone to these injuries and Cedars should have been heads up.

Day, by the way, is the founder of the TCW Group, an investment management firm. The firm handles $130 billion in assets.

McMahon's rep, Howard Bragman, says, "We had hoped to avoid a lawsuit, but our discussions were not fruitful and we were left with no other options. That being said, we believe our suit has great merit and we expect a favorable resolution."

McMahon is suing for unspecified damages. Calls to Cedars were not immediately returned.

62. Jeez, the guy's 85 years old. He’s lucky the fall didn’t kill him. A lot of old people die in the aftermath of falls. They should have x-rayed him.

My daughter walked around with a cracked pelvis for 4 weeks. The doctor treated her for a pulled hamstring after doing a split in dance class the wrong way. The old coot, who is supposed to be a specialist, never x-rayed her. I had to insist when she wasn’t getting any better. Not only was the pelvis cracked, she had pulled the muscle on the back of her leg right off the bone.

Two years later, she still has problems and she’s only 17 years old. I wonder what would have happened had she gotten the right treatment early. I hope she doesn’t end up with arthritis because of it, a lifelong condition. I didn’t sue, but I did switch doctors.

Regardless, I wish him luck, including that money spending wife of his.

63. When my Dad was in the hospital over there, I use to come and bring him whiskey all the time, then the nurses use to fondle him he told me when he was drunk.

65. if he slipped and fell in a house whose owner is a billionaire, why didn't the billionaire offer to pay for all his medical bills and pain and suffering? ed could sue him on judge judy but the limit is only 5K. your suppose to have hand rails on stairs that is enforced by the building code. it doesn't matter how many or what. and they have to be a certain height, that is why we get our house inspected when it is built or sold.

69. I wonder fi they did a bac (blood alcohol check) to see if he was drinking at the time.Personally I like being abused by nurses in the hospital especially of a sexual nature. Some of the nurses I have seen over the years are smokin hot. I'll be thinking about getting into an accident or something just to get into the hospital and next to some of those sexy nurses. So all you NURSES out there, I will be coming shortly.

70. Hey Everybody! I know that I am usually a wise-ass on TMZ's site (see Fabio: I didn't get hit by the goose!) but I gotta do my good deed thing now. I agree w/those folks saying these lawsuits are probably a direct result of Ed's poor financial situation.......that's kind of obvious. BUT......and please bare with me kind people, Ed "Here'ssssssssss Johnny!" McMahon is a show business icon. He comes from the "Golden Age of Television." Now when I was in my teens and even a bit older I would've puked when someone tossed that phrase out to chew over. I would've laughed so hard I'd doo-dooed my tighty-whiteys! BUT now with having put a few miles on the life-experience treadmill I've come to re-think a few things. One of those little lessons is life is too short and appreciate those little things that bring a smile to ya, cause you to laugh, and even shed a tear. I grew up (and stayed up way too late too often) with Ed McMahon and the Tonight show and Star Search and a whole bunch of other things Ed was involved with. He unselfishly helped out with the Jerry Lewis/MDA telethon, appeared at and hosted numerous fund-raisers for WWII veterans and others, and without publicity nor expectation for repayment helped out many "down-on-their-luck" entertainers. I know if I was reading this for the first time I would be accusing some p.r. stooge or Ed's manager of bring out the three kleenex story......but this one's from the heart. I do not know Ed McMahon personally or anybody associated with him in anyway. I have however enjoyed the entertainment he's provided over the years. Yeah, Yeah I hear you folks out there saying: but that was his job dude. O.K. that's true and I'm sure he was welled paid for a lot of his efforts along the way. But I never thought about all of that when I laughed my ass off or shed a tear or sat transfixed watching or listening to him. Somehow, someway I hope some mega-star who's pulling in some serious dough and enjoying the fruits of their labor will dig into their pockets and throw a few bucks Ed's way and at the very least help pay off his current debts. Jeezes,....... with some superstars getting 10, 15, or even 20 million to do ONE movie, or pocketing a couple of million for one album you'd think they could spare some coin for a Hollywood legend. If I had the cash I'd do it quicker than a Kardashian would do a sex tape. When a media whore like Paris Hilton can transfix the mass-media and make money off of it..........well hell a true entertainer like Ed deserves better.........a lot better. O.K. for those crack-pots saying "but he got himself into this mess" I hear ya. But it is what it is.......a decent guy is down on his luck. I'm gonna say a little prayer for Ed and hope his future brightens up for him and his financial woes will get worked out. to TMZ: Sorry for the length of this BUT PLEASE LET IT STAY! When you sue , you've to see EVERYONE who's involved .

Ed is down and out now . He losing his home , he's older ,

know he has no where to go but down , but to pick himself up .

He has to sue , to recoup his FINANCIALLY problems .

Will his friend like him sueing him ??? I doubt it .

Just a comment .. ALL CELEBS CAN PAY THERE HOMES OFF , MUCH EASIER THAN YOU OR I .

We're people ( Omit celebs / millionaires / billionaires ) who lives day by day , work hard for our money.

With the ecomony , job layoffs , I can see why people are in that situation . COMPANIES give CEO'S

millions of dollar bonuses , but the AVERAGE worker , doesn't get NO RAISE , AND MAKE less money

per hour . My point is ........There's no way we can pay our home off in full like celebs , millionaires

or billionaires , they can pay EVERYTHING in full , if they wanted too .

Middle class people are "THE HARDEST WORKERS , IN UNITED STATES .

This economy only going to get worse than better . So save all the MONEY you've

because you will need it . Pay off your bills , buy groceries , and whatever money you've left
