Ed to Cedars: You Abused Me

Ed McMahon is suing Cedars-Sinai Medical Center in Los Angeles and billionaire Robert Day for his slip and fall at Day's house, which resulted in Ed's broken neck. He's claiming, among other things, malpractice and elder abuse. And he says Cedars made him feel like "a bobble head."

In 2007, McMahon went to Day's home, slipped on what he calls "unsafe entry stairs," reached for non-existent hand rails, fell and broke his neck.

He was taken to Cedars, and in a lawsuit filed today in L.A. County Superior Court, claims the docs "failed to take an X-ray of McMahon's cervical spine, in spite of his complaints of severe neck pain." McMahon claims he was released by Cedars with a broken neck when he should have been treated.

Two weeks later, McMahon's doc finally X-rayed Johnny's sidekick and discovered the problem.

McMahon's suit says he was so given the bum's rush in and out of Cedars that "he felt like a bobble head."

As for the elder abuse claim, the lawsuit alleges elderly patients are prone to these injuries and Cedars should have been heads up.

Day, by the way, is the founder of the TCW Group, an investment management firm. The firm handles $130 billion in assets.

McMahon's rep, Howard Bragman, says, "We had hoped to avoid a lawsuit, but our discussions were not fruitful and we were left with no other options. That being said, we believe our suit has great merit and we expect a favorable resolution."

McMahon is suing for unspecified damages. Calls to Cedars were not immediately returned.

91. I have had many many experiances with incompatent Doctors. I now question the heck out of them and also do my own research on the internet looking for less evasive treatments. Some Doctors remind me of car salesman, except they try to sell you the most expensive procedure, even if you really don't need it, didn't used to be that way but many things have changed over the years, buyer beware.

92. Personal Injury is a Tort. California Statute of Limitation for filing a claim in Tort is two (2) years. You young, cynical idiots berating an elderly injured man for waiting too long to file this lawsuit are merely ignorant of California laws. Grow up and get educated.

It didn’t say he xrayed his heart area, it said he xrayed him. He probably complained to him about his neck. And the commercial you so helpfully posted has a copyright of 2007. Ed was injured in March 2007. The commercial probably preceded the injury.

But thank you for your diagnosis. Imagine all the money real doctors waste on medical school They could just ask you.

98. As my id says my husband did break his neck and i had to fight with his ER doctor and nurse to haver them take another look because his first x-ray showed nothing . The paramedics knew he had a broken neck when they brought him in. he could not move . But the good old doctor was ready to send him home with Tylenol. It was not until I told the doctor that if he himself could help me move my husband out to the car I would take him home. Then the Dr states "maybe we missed something" gives him an MRI and then decides to keep him ovwer night. It was not until the following day that we knew he had broken his neck . Surgery was done the day before he turned 40. You better beleive that i looked into suing the hospital for negligence. I forgot to mention that during my 6 hours in the ER my friend who is an attorney could not beleive that they were going to send him home and made it very clear to the Dr. that anything that happened in moving my husband he was on the hook for. Don't fool yourselves that Drs. and hospital's know best and as for Ed go get them. we have been where he is at and we are not rich or even middle class our settlement with the hospital didn't even pay all the medical bills. So Ed sue the hell out of them!!!!!!!!!!!!!

Nope - he waited for more than two years... if you go back and read the Complain (in pdf), you'll see he was granted an exemption from the Statute of Limitation.

In other words he didn't do anything for 2 years and then after speaking with J. Shyster Flywheel, Esq, convinced him he would likely be given some money to 'go away' to be paid from the malpractice premiums, etc/

So now that his fancy house in the fancy gated community is in foreclosure, one bank is suing for a 200.000 loan, another for well over half a million dollars in unpaid credit card purchases... Ed has a 'Eurecka!' and decides the best and fastest way to get his mitts on some cash is to sue.

You'll notice that his lawyers' attempts to shake down the named people and entities before a trial was unsuccessful... all the other lawyers probably told Mc Whiner's lawyers to get stuffed. So Mc Dork's lawyers ratched it all up a notch and said 'we'll see you in Court ' which all those other lawyers laughed at McMahon's rep, Howard Bragman all the way out of their collective offices!

I hope the trial Judge dismisses this lawsuit for being a frivolous lawsuit designed to embezzle money.

So what - so it was 'copyrighted' in 2007. Ever heard of re-running an ad and actors getting paid residuals? It happens all the time in radio, and TV.

And thank you for noticing my comment and taking the time responding to it and pretending you know what you're talking about. Imagine all the money real doctors waste on medical school They could just ask you for Intervenor Status or Amicus curiae for Fast Eddie.

105. The hospial will probably settle because he has a good case.

Don't know about Robert Day,though. It all depends on how muc Ed is asking for and how pissed Day is about this.

Depending on the $ amount in question, Day may want to throw him a bone and let his home owners insurance pay Ed.

However, most rich people will haggle over a dollar, and billionaires are the worst.
