So Janet Jackson's naked nip won't end up costing CBS half a mil after all.

A federal appeals court just tossed the $550K fine against CBS for her infamous 2004 "wardrobe malfunction," ruling that the FCC acted "arbitrarily and capriciously" in slapping CBS with the fine.

CBS didn't immediately have comment, nor did the FCC.

31. I am glad that CBS is getting out of the fines. What Janet and Justin did was dumb but CBS didn't know it was going to happen. Its like when NBC got fined because Dale Earnhart, Jr. yelled out the "f-word" on air because he lost a race a few years ago! Its not like they knew it was going to happen. FCC needs to apply those fines where warrented.

As for parents that want to holla about "my kids were watching", well there are a whole lot worse than what Janet did on regular TV.....in the Daytime!
