Lawsuit: "Swing Vote" Was MY Piece of Garbage!

In what may be considered the worst career move ever, a screenwriter is actually claiming responsibility for writing the Kevin Costner clunker "Swing Vote" -- and get this, he's now filed a Federal lawsuit claiming a whole mess of people, including Disney, Touchstone, Kelsey Grammer and Costner all ripped his idea!

In the suit, filed today in the U.S. District Court in NY, Bradley Blakeman -- who is also a political commentator and former Bush staffer -- says in Spring 2006 he gave a copy of his script "Go November" "in confidence" to actor Kelsey Grammer. Blakeman says his movie "involves a unique 'down to the wire' presidential election, hinging on swing voters." Imagine his surprise, Blakeman says, when what he calls the "extraordinarily similar" film "Swing Vote" was released last week. Now he's suing for unspecified damages.

Grammer's rep Stan Rosenfield tells TMZ "I am not sure why Kelsey was even named in this suit. He was an actor who signed on to the project AFTER the script was written. As Gertrude Stein once said of Oakland, 'Once you're there, there's no there there.'"

17. whether the final product is a stinker or not, is not the issue. the issue is whether grammer and the boys stole the script idea from mr. blakeman. if they did, and it's fairly clear they did, then blakeman should be compensated. and then he and everyone else can move on. cheating someone is not the right thing to do.

18. I once worked at Disney and pitched an idea based on a novel a friend wrote...they loved it, gonna make it, yada yada. I was the assistant to two writers at the time and the man who I pitched to is still riding high in the business having climbed the ladder one dishonest rung at a time, coming out half way up the ladder. Two weeks after the I love it gonna make it call, I got another call saying a meeting was held (with heads of production) and it didn't make the cut. Oh, thanks for letting me know. An hour later, my boss is trying to use a video and our office machine is on the fritz...so we head up to the upstairs conference room to use the video machine up there and I sit at an oval conference room table where some meeting notes have been left. I start scanning as my boss is turning on the video equipment and much to my surprise, there is a blurb about my project, saying they will develop a "Disney" project based on the idea but changing names and titles to retain ownership. I freaked out and confronted the honcho with the news that I had read the memo. His response, anger at whoever had left the notes in the room because now he had to shelve the entire idea. Hollywood is only as good as the character of the men running it.

19. I'm embarrassed to admit that 2 writing partners and I wrote a treatment called The Vote back in 2001 that was about a Loser in a trailer park who ends up having the deciding vote in the presidential election. We registered the treatment and even pitched it to Disney to no avail. The main difference is that our script was freakin' funny though I haven't seen Swing Vote so I may be too harsh in my pre-judgement. Hey, this stiff happens all the time and there's nothing anyone can do. C'est la vie.

20. I agree with most of the people who have commented, Brad should be compensated for what he has created. Whether the movie was horrible or fabulous, there should be some compensation. His idea was stolen and tweaked and those bastards at Disney and even bigger bastard, Kelsey Grammer think it's okay???. Ridiculous! How do they sleep at night??? After reading through the blogs, it sounds like this has happened to quite a few innocent, trustworthy people. Hopefully Brad will follow this lawsuit to the end and make sure Disney and Kelsey Grammar pay up for their dishonest actions and make an example of them!!!
