Shia Won't Be Charged, License Will Be Yanked

TMZ has learned Shia LaBeouf will not be charged with Driving Under the Influence. The L.A. County D.A. just rejected the case on grounds of insufficient evidence.

LaBeouf was arrested after his car accident on July 27.

He is not off scot-free. Shia will almost certainly have his license suspended because he refused to submit to a blood alcohol test. Steve Whitmore from the L.A. County Sheriff's Dept tells us Shia's DMV hearing is tomorrow.

31. but come on now? "shia email me" i wouldnt be holding my breath on that one...id rather plaster my phone number up here or tell him to go to my myspace than to say email me...he's too hot and he knows it...what i would do to him......

32. Actually, the police originally claimed they were waiting for the results of his BAC before proceeding with the charges.

Well the results came back and he was under the limit.

So now to save face.. since they already were forced to admitted he didn't cause the accident ..they are going to complain that he didn't submit to the breath analyzer at the scene.. when it isn't even standard protocol for a breath analyzer to be given at the scene when they know a "suspect" is going to be transported to the hospital and get a BAC. A BAC that Shia did submit to and of which the results cleared him.

Boo Hoo Cops.
