CHP to Heather: The Facts are the Facts

Heather LocklearCHP sources in the office investigating the Heather Locklear case tell TMZ the motives of the woman who called 911 are irrelevant -- and we're now told there are other witnesses who will back up her story. The case is now in the hands of the prosecutors.

One CHP official told us that up until we posted our story last night, they were unaware that Jill Ishkanian -- the woman who called 911 -- had called a paparazzi agency immediately after she made the emergency call. But the official says it has no bearing on the case. He told us the case file already has been referred to the Santa Barbara County D.A. and it's being reviewed right now. He added the decision on whether to prosecute will be based on the results of drug testing -- due in around three weeks.

The official says since the arrest, the CHP has received calls from other people who tell the same basic story Ishkanian told. He says Ishkanian went to the cop shop on Saturday night and gave a written statement of what she saw and also told her story, which is on tape. He added, "There's no reason to believe the witness is less than credible."

31. Let's wait for the facts before we jump the gun. Either this lady is a fame hunting stalker, or Heather was impaired. Now this woman obviously followed her into and out of the store. She waited for her chance. then made her move. Hopefully it will backfire on her. I can understand wanting to get impaired drivers off of the road, but just because you think someone is under the influence doesn't mean they are. And whatever the officers have to say, that's called covering their own ass's.

32. Can anyone please tell me how someone gets arrested for dui and wreckless driving when she was parked in a parking lot with her engine off when the cops found her! It seems like the cops just wanted to arrest a celebrity. Shame on them! I hope Heather knows how many people are routing for her!

34. Doesn't matter who called the fact was she was impaired. And the cops didn't see her driving?? So, her car obviously didn't get into traffic to block a lane of traffic by itself. And wasn't she out wandering around in the road? Heather hopefully isn't blaming this person for turning her in but thanking her for possible saving her life. This doesn't mean she isn't a good person. Prescription drub abuse is a horrible thing and it can happen to anyone...believe me I KNOW!!! They should send her to a drug counselor to see if she needs rehab and pull her license for 8 months if the tests are possitive for drugs. She knew better thab to drive the pharmacist told her and the prescription bottle would have told her not to drive. Besides I bet it will come out that she was abusing her meds by taking more than she was prescribed. People don't pass the blame..don't be enablers...she has to get help before she totally wrecks her life or ends it!!! She is a good person...just one with a addiction. Heather I share your pain and believe me I know how scared you are right now. Please go get help before it is too late. You don't want to but you have to...do it for your daughter!!!

35. Wow, i can't believe people would defend anyone driving loaded, my Grandparents were both killed by a drunk driver. Does it really matter hoy it was reported or why?. Furthuremore people who know Heather, understand her battle with drugs.

36. This "Jill" person can , and should be prosicuted to the fullest extent of the law for reporting a false emergency. Do you notice on the tape where when asked for her name, she kinda hesitates. She knows shes doing somehting wrong !!!!

38. Aside from the impairment issue, I will never believe the cop taking the cell phone pictures was doing so for official reasons. Since he had nothing else to do except be there for backup (in case any officers were overcome by their own tiny erections), he took the opportunity to devise a whole new paradigm and career path we can now call "coparazzi". I imagine he took his little cell phone to a bar that night to see if he could use it for skank bait.

39. I've seen this before. She is 47 years old and her looks are fading. She senses it is almost all over for her. She will dry up soon. Many women have these feelings at this age. The clock is ticking and she hates it.

40. What the lady did was rotten, but unless she slipped Heather drugs without Heather's knowledge that actually caused the intoxication, it's irrelevant. This woman took advantage of Heather, but Heather is the one who was behind the wheel under the influence of something, and THAT is what put herself and everyone else on the road with her at risk. So if those toxicology tests come back positive, then Heather should be prosecuted, just like anyone else would be.

41. If she was driving with pharmapseuticals in her body, it seems like she pulled over when she realized she was impaired. This seems to be the case as she was not driving when the police showed up. It gives the impression that she was acting prudent.

42. x17 says TMZ paid Ishkanian 30 thousand for the pictures. Is that the same as 30 pieces of silver.

It would be fair and right if you apologized for subsidizing Heather's embarassment and stopped doing business with the agency Ishkanian ownes or works for. You guys can make Ishkanian an outcast in the PAP community and you owe that to her for the despicable stunt you unwillingly are involved in.

43. This is BEYOND scary to me. I guess anyone can call the cops on any car they see - even an ex-lover or estranged friend.. and lodge a false claim that gets the person arrested?!? Even if Heather's drug test comes back negative - there will still be people that think she was guilty of a DUI offense.

Did they really arrest Heather solely based on one eye witness who claimed she saw Heather driving erratically?

That's VERY scary people..

44. Kay,

How do you know she was impaired? Her drug test results are NOT back yet. Her blood alcohol test came back negative - meaning she wasn't drinking. She was arrested based on the accusation of one witness who seems to have credibility issues. Nobody knows whether she was impaired .. why don't you wait until the test is back before you throw out accusations.

45. You guys that voted "no" she should not be prosecuted. If she causes a wredk that kills one or more of the most important people in your life, would you still vote no? Don't say that can't happen!
