There has to be substantial evidence of sexual intercourse (i.e, proof that he has "intentionally or knowingly penetrated" her.)

Simply dating her is not a crime. It's not statutory rape if there is no penetration. (Hence, the reason for the word "rape" in this phrase.)

So even if they are secretly shackin' it up, he can't be charged for it without proof. Sucks for the parents! (If they wanted him locked up anyway.)

138. I don't see what the big deal is anyway. She'll be 16 next month, he's 20...four years, big whoop! When she's 17 he'll be 21 and then no one will even care anymore. I've seen waaaay worse.

One of my closest friends started dating a 29 year old when she was 18.

My parents are six years apart. When my dad started kindergarten, my mom wasn't even born yet...kinda weird when ya think about it that way, haha.

BUT, the little tongue thing was kinda inappropriate. Perhaps she did it intentionally just to get attention. B/c I mean she KNOWS there are gonna be cameras there, hello it's fashion week, duh!

It's not statutory rape unless the two of them have sex. It's perfectly legal for a 15-year-old to date a 20-year-old as long as they aren't engaging in sexual behavior.

That doesn't excuse Disney or Miley's parents, however. They are exploiting her as sexually as they think they can get away with.

Her father and mother already allowed her to be photographed in that bedroom pose in Vanity Fair. Their protestations and crocodile tears don't cut it, either, because they knew before they signed the contract that Vanity Fair and the photographer both have a reputation for those kinds of photo spreads, and they still gladly and willingly went into that deal. It's not that they thought that Vanity Fair was some sort of a Christian Bible Study magazine.

Miley's parents are definitely in cahoots with Disney in exploiting her, and they want her to show as much sexuality as she can get away with up to the point where it starts hurting sales. So far, that hasn't happened, and so the barely concealed eroticism will continue. As Miley gets older, Disney and the parents will have Miley showing us more and more.
