Not true. If it is found out that Justin has had sex with Miley, he can be prosecuted for statutory rape, irrespective of whether she plays the victim or not. If someone catches them in the act, Justin can still be prosecuted, even if both of them assert that the act was consensual. Or if Miley gets pregnant and they do a DNA test that shows Justin to be the father, he can be prosecuted, even if they swear that they both wanted to do it.
The laws for statutory rape simply have to do with the ages of the two parties. Consent or non-consent have nothing to do with these laws; nor does victimhood or non-victimhood.
Once both parties have reached the age of consent, THEN all the issues of victimhood, consent, etc. will come into play in the ways that you are describing.
In practice, people are not always prosecuted for statutory rape. Sometimes prosecutors are lenient; sometimes if the kids get married right away, the cases get dropped; sometimes prosecutors just don't want to waste their time and resources on cases like this. Nonetheless, the laws about statutory rape have to do simply with the ages of the parties, and as I have stated, those laws simply specify that underage sex is illegal, and consent and victimhood do not have anything to do with this.
