Hudson Victim -- Murdered by His Own Gun?

Jason HudsonOne of the victims in the Hudson murder case could have been shot to death by his own weapon.

Jennifer Hudson's brother Jason owned a gun that may have been identical to the murder weapon, according to law enforcement sources and neighbors who spoke with the Chicago Tribune.

According to those sources, Jason said the gun had been stolen from the family home -- the crime scene -- a few months ago.

Law enforcement sources are now investigating whether the gun used in the Hudson triple murders once belonged to Jason Hudson.

Jason's brother-in-law, William Balfour is the suspect in the case.

78. Here's something else I'll throw out there.

I think there is the possibility of the prosecutors going for a grand jury indictment. This would mean they have even more time to not make all evidence public, as the proceedings can be closed to the public. I can think of a few reasons for doing this.

Does IL use grand juries for murder indictments? Are there any real legal experts out there? As opposed to all of us amateur sleuths with our CSI legal knowledge?!!

79. @76, Thank you so much for the explanation, Mindy! It certainly seems to be beneficial for the CPD, and I agree there are probably plenty of people talking and many "truths" to try and wade through.

I don't blame Jennifer for not attending a public service, either. I wouldn't want a bunch of people who were not immediate family watching me mourn. While there are plenty of celebs who would be out there in front of the cameras telling their tales and such, I really admire Jennifer for how she is handling herself - and respect her decision and her need for privacy right now. I can't begin to imagine how she feels - but I can empathize. Poor girl :(

I just saw on nacy grace..william mother said they refuse to give william a lawyer when he ask for one thats when they ship him off to prison and she said they refuse to let her see william...some lawyer needs to jump on william case asap be4 they frame that boy..also i would sue the police department because by law they can't refuse him a lawyer.

Who ever said it is mostly white women who murder their children are dead wrong!I don't know the names but on two seperate occasions, one black mother threw her 3 children over a bridge because God told her to do it. The second woman did the same damn thing, just threw her babies over a bridge into icy cold bay. How about the black female thing who put her baby in a microwave and cooked her to death becuase she did not want to lose her man!Only someone with a true mental illness could do this, but it would seem like an everyday occurance and normality in Chittown.Way to go Obama You must be so proud of your state and what you have done to make it a better place to live and work!Can't wait until we see what you do with the country you are about to be voted into becaude you are black. Well it sounds like in one weekend alone, there are about a dozen or more less voters because they were murdered!! In Chicago and in most parts of the country.Maybe by Tuesday, all the blacks would have killed eachother off just in time to not be able to vote!

He's not being held in relation to the Hudson murders. They have a few reasons to hold him on the parole violations, such as missing his meetings with his PO and missing his educational requirements. I believe it was anger management. There are a few options there, he's given them more than one thing to work with.

Even if he is completely innocent as far as these killings go, I don't feel too sorry for him as far as the parole violations go. Parole is a second chance and his crime was pretty serious.

If he requests a lawyer while being questioned about the murders, they have to give him one. If he chooses to just stop cooperating, he's allowed to do this.

If you're on his side, these things aren't necessarily bad. You don't want just any public defender if it's a triple murder. Don't throw the first lawyer on the list out there. And there are some pretty wild theories out there. If William should need protection, he's in a good place.

I'm a certified paralegal. The Grand Jury process in Illinois is a huge joke. Any prosecutor can easily get an indictment against anyone with very little to no evidence. It's basically a rubber stamp system here in Illinois.

You're incorrect about the lawyer for Balfour. They took him away over violating parole. This is not a new charge, and as such he has no entitlement to a lawyer. A person has to be accused of a new charge in order to merit protection under the 6th Amendment.

No way that wonderful human being did anything that should land his ass in jail. The jails are full of guys like him and they are ALL innocent, don't ya know?

Thanks for that. I think the same could be said for the grand juries in lots of states! Prosecutors have alot of leeway. Having said that, I can also see why it would be useful and a good move. Like many things in our justice system, it can be a mixed bag.

Is it used very often there for murder indictments? If so, is it because of weak evidence or because they don't want to tip their hand in the interest of getting suspected individuals to make a dumb move?
