64. Judge Judy said it best-we classify people under 18 as children and do not allow them to make decisions for themselves because they are too stupid to do so themselves. Perhaps the SURVIVOR and her family don't want this brought up again because the mother has some guilt issues over her lack of good judgment. I'm sure the girl doesn't want to go through all this again 30 years later and she shouldn't have to. Polanski was found guilty and like someone else pointed out, nothing has changed. It is much too late to point out irregularities in his trial. Talented, yes. Pervert, absolutely. I don't care if she was under 18 or not. Doping someone up and taking advantage of them is illegal; a la Andrew Luster. And speaking of Luster, who holds the bond on him? Maybe they would like to go get him back.

67. Polanski always has been a creep and a loser. To me me it seems like just part of the karma he deserves if he never is allowed back here. He makes me sick.
Not only is he a pervert and pedophile, he was never faithful to Sharon Tate, who he'd been married to. Then he made some sick comment to the effect of "it was good Sharon died when she did, before our love could die"....that is the sort of thing he says when he thinks he's being clever. Imagine him saying that about his murdered wife. AND he's on record for having a premonition of Sharon's death...and yet he did nothing to stop it. He let her return home ,alone, to California while he stayed on in Europe.

But as far as guilt is concerned, the questions I would ask would be:

1) Why was she there without a parent or guardian? (That to me would suggest playing older than she was, for starters.) That just isn't the way it works for underage models. Nobody in their right mind sends their 13 year old off with a guy to a photo shoot alone.
2) What did she look like and act like? If she was a good enough actor and experienced enough sexually and well enough developed physically (as some 13 year olds definitely are), could she have been playing legal convincingly? For example, whenever a pic of Ali Lohan is displayed, multitudes of posters remark on how old she looks (certainly not 14 or 15). Now, Ali can't act well enough to pull it off (she would be identified as young and immature as soon as she opened her mouth), but maybe another youngster could.
3) Did Polanski know how old she was? (That's actually rather crucial, if she was playing an older role in this game.) I know the law will claim it doesn't matter, but that doesn't seem quite right to me. On the one hand, I'm all for protecting children from doing really stupid things no matter how much they want to. But I have a harder time blaming an adult who thinks he's dealing with a legal 18 year old. This is a really murky area. Who knew what when and where?
4) Did he definitely drug her? Is there any concrete evidence for that? And of course, that brings us back to whether or not it was voluntary on her part for any drugs or alcohol (if she was acting the role of a non-minor).

The problem with her later testimony in court is that it may not be reliable if she had already established a pattern of lying about her age and successfully acting the part of a non-minor. That could explain why now she says she wasn't hurt by it - I can understand reluctance to say she lied (perjuring herself), but if she told the truth at the time, it's harder to understand why it wasn't harmful to her.

The fact that Polanski accepted the one charge of sex with a minor is actually no proof of anything - it was a plea bargain, it doesn't prove that he knew she was a minor at the time or anything else. And the fact that he didn't show up for sentencing could just as easily mean that he felt he had no chance of fairness in the whole procedure -he had other places he could comfortably go, so he went. Obviously the authorities weren't terribly worried about him, if they let him out on bail. I would have expected otherwise if they had loads of evidence for all the charges and for a pattern of pedophilia. And the European authorities haven't been anxious to extradite him to the US (or is it that nobody even bothered to ask for extradition? perhaps because no other judge would accept the US conviction on review, maybe?).

The whole case just sounds awfully odd.

70. The girl and her mother admit they let her go there willingly by herself but this doesnt make it ppen season to have sex with her. She was underage -period! I send my child willingly to elementary school but that doesnt mean anything goes and is ok because I chose it. He ADMITS he had sex with her and ADMITS he knew she was underage. End of story -GUILTY! You dont sleep with under age girls or boys even if they are handed to you naked on a silver platter! He was the adult male who chose to have sex with underage girl. He needs to deal with the consequences of his free will action.

71. She was 13, which in the US means a 7th grader. For all you freaks (women included) out there saying she could have LOOKED 18, have you ever seen this guy's films or read his testimony? He was fascinated with prepubescent girls and ADMITTED that he knew her correct age. He also admitted that he gave her champagne and qualludes.
