Man Sues Dead Victim in Brandy Crash

A man banged up in Brandy's fatal 2006 car crash is now suing the singer for allegedly causing the wreck -- and suing the lady who died for allegedly contributing to the chain reaction collision.

Donald Lite is going after Brandy and Awatef Aboudihaj -- the married mother of two killed in the accident -- claiming their disregard for road rules caused the multi-car pileup that left him with extreme physical damage.

In the suit, filed last week in L.A. County Superior Court, Lite says their failure to keep a safe distance, mixed with their inability to travel at a safe speed, caused Brandy to rear-end Awatef, which sent Awatef's car smashing into his.

Lite says he's suffered "serious and permanent injuries" that racked up a lot of hospital bills -- and is suing for an undetermined amount.

16. Google "car accident Brandy" and you'll see the stories. Apparently she was extremely distraught at the time of the crash, and still suffers mentally from the ordeal. Have a heart people...

"Brandy was involved in a car accident Dec. 30, 2006 in Los Angeles where there was a fatality. She wishes to publicly express her condolences to the family of the deceased. Brandy asks that you respect the privacy of everyone involved at this time," her publicist, Courtney Barnes, said in a statement.

Brandy, 27, was not arrested and she has not been charged with a crime.

The accident happened at 10:30 a.m. on Dec. 30, 2006, on the 405 Freeway in Los Angeles. Brandy was driving her 2007 Land Rover at 65 mph and did not notice that cars in front of her had slowed considerably, law enforcement sources told TMZ.

Brandy's vehicle struck a 2005 Toyota, according to TMZ. The Toyota then hit a 1989 Toyota. The 2005 Toyota then slid sideways and hit the center divider. As the 2005 Toyota came to a halt, it was struck by a 1988 Acura.

The driver of the 2005 Toyota, Awatef Aboudihaj, was taken to Holy Cross Hospital in critical condition and she died the next day. Aboudihaj, a 38-year-old married mother of one, was a Los Angeles resident.

17. Brandy should be charged, this is ridiculous... How is she getting away with this? I bet if it was a none rich person or a none famous person they'd be in jail right now... The system if corrupt..

18. Regardless it's Brady's fault, she should be paying attention to the road. When you're driving on the road we all know that you can NOT tell if the idiot in front of us is going to stop suddenly "therefore" that's why you have to be alert at all times. I bet Brandy was talking on her cell phone when the accident accrued. Obviously Brady wasn't paying attention to the road.

19. She is a multimillionare the least she could do is pay his bill's and pain and suffering. These rich so called starts think there going to take all there material bull sh@#. With them when they die the only thing that happens is the family fights for everything they can get threre greedy hands on
So pay up Brandy you have no problem giving your broke brother money for nothing.

22. If the facts in post #16 are correct, then I agree - don't be suing the lady that died; HOWEVER, Awatef's estate should be suing the living heck out of Brandi. I HARDLY call this a frivolous suit - a life was lost.

23. I usually do not comment on these boards, but I am appalled by some of the comments. Car accidents happen daily and unfortunately some result in the loss of life. That is why you are required to have liability insurance in most states, if not all. If I remember correctly, the investigation revealed that Brandy was not on a cell phone, there were no drugs or alcohol in her system, and she was not driving at a high rate of speed. So, I am not sure why some of you feel that she belongs in jail. To put her in jail would be treating her unfairly because she is a celebrity. Yes, she should have been aware that the traffic was stopped in front of her, but I am sure most of you are guilty of not being alert at some point in your life. I know that I am, and I also rearended someone. Fortunately, no one was killed or hurt. It is very sad that this accident resulted in a fatality; however, if it were anyone else behind the wheel, I do not think there would be multimillion dollar lawsuits. All of you perfect drivers should remember, "There but for the grace of God, go I".

24. I SWEAR YOU PEOPLE ON HERE WITH YOUR STUPID COMMENTS THAT SHE NEED TO BE PUT IN PRISON.. I THINK THAT'S WHY ITS CALLED AN ACCIDENT BECAUSE THAT'S ALL IT IS. SHE WAS TESTED FOR ALCOHOL, DRUGS AND EVERYTHING SHE IS ONLY A DAMN HUMAN.. SO WHY SHOULD THIS MAN AFTER YEARS DECIDE TO SUE BE ALLOWED TO? BECAUSE SHE JUST RELEASED AN ALBUM OH MY KICK ROCKS... 25. Unfortunately in most cases in order to sue one person for causing an "accident" you have to sue them all. In this instance one of the defendants unfortunately is deceased. As well you lose that witness so more than likely if insured the insurance company will just settle up to the limits of the policy. When and if it actually goes to trial the jury then has to determine what percentage of fault each driver is responsible for and then how a judgement would be divided. For what its worth most of these things never see a jury, this one may as you have someone with deep pockets.

26. BRANDY IS NOT AT FAULT IF THERE IS AN ACCIDENT IN FRONT OF YOU ON THE FREEWAY ITS A CHANCE YOU MIGHT HIT THE CAR IMMEDIATELY IN FRONT OF YOU, ANYONE WHO LIVES IN LA KNOWS HOW TERRIBLE THE 405 IS AND DONT BLAME HER FOR THE DEATH OF THE WOMAN.

BRANDY WAS NOT OUT CELEBRATING SHORTLY AFTER. SHE WAS NO WHERE TO BE FOUND FOR MONTHES THEN SHE SLOWLY STARTED COMING BACK OUT AND WAS BEING DRIVEN BY A DRIVER AS SHE WAS TERRIFIED OF DRIVING AND HAD FLASH BACKS.. IT WAS A TERRIBLE ORDEAL FOR HER AND THE NORWOOD FAMILY
