Rita to Anna's Men: Nothin' Wrong with Gay Sex

The famous "Seinfeld" line, "Not that there's anything wrong with that" is forever part of the pop culture lexicon. And if Rita Cosby has her way, it will be a legal defense, too.

Cosby claimed in her questionable Anna Nicole Smith book that Larry Birkhead and Howard K. Stern had a sexual tryst -- which was allegedly videotaped. Stern has filed a defamation lawsuit against Cosby.

Now...in a response filed earlier this month, Cosby says her claims can't be defamatory because "engaging in a homosexual tryst, even if videotaped, does not reflect poorly on someone and in the 21st Century it most certainly is not a 'criminal lewd act.'" Cosby should bottle her gall and sell it for $60 mil.

And speaking of $60 mil... that's how much Stern is suing Cosby and the publishers of her book "Blonde Ambition" for.

The validity of this concern became even more evident from discovery in this action, revealing that Vicedomine had her trash rifled through and then placed on the internet with commentary from Art Harris is and Stern’s suing the witness Speer only hours before his deposition.

No thanks to Elaine, Jerry must work hard to prove he is straight when a college reporter mistakenly reports that he and George are gay, "not that there is anything wrong with that." Things really get out of hand when the article is picked up by the New York Post. Jerry ends up dating the college reporter to clear his name, but all does not go well.

When this episode was first presented to NBC, they thought it was an absolute disaster. One of the main problems was that it was far too racy for public, and knew that it would offend the gay and lesbian couple. Later, as they were discussing how they could fix the insults to gays, someone in the meeting was saying that there's nothing wrong with being gay. This comment led to Jerry proposing the "not that there's anything wrong with that" line, which turned out to be a huge hit. The gay and lesbian communties especially liked this episode.

There are many factors to take into account in this as well:

California's passing of the Proposition 8 further capitalizes on the 'majority' still viewing gay citizens as unworthy to the same civil rights as others.

Both men are single, regardless of sexuality, shouldn't that be their privacy? HKS might be asked by a female suitor if he is or if he isn't gay/bisexual in the future? Would that bother any other single straight men, to have to defend himself for the rest of his life?

Rita offers absolutely no evidence but the views of virtually unknown wanna-bees, that have either disappeared, retracted their statement, or admits it was their own opinion. Hatchette defends itself with the author is responsible, which is professionally irresponsible for any publisher, especially one of its caliber.

You understand she (Rita) had mulitply sources right? So that means that the sources told Rita that it happened and Woolaa she put it in the book. She had sources! How are those Nannies and Lincoln Baines these days? Where is Liz Thompson that tried to discredit Rita? They were all a no show at the inquest, where oh where can they be, I wonder?

In an effort to make the reporting fair, we did make a significant effort to include other points of view in many places, in particular from friends and supporters of Howard.

These include comments from Ron Rale, Krista Barth, Wayne Munroe, King Eric Gibson, Brigitte Neven and Gerlene Gibson, Alex Denk, Ray Martino, David Giancola, Patrik Simpson and Pol Atteu, among others. Messrs. Simpson and Atteu were close to Howard at that time and were certainly two of his most vocal supporters.

Entertainment, The Anna Nicole Show is a “reality television” show. It generated significant press in the years it was on — generally about how incredibly outrageous Anna and her friends (including Howard K. Stern) were, particularly surrounding the seeming abuse of alcohol and drugs — and I was basically familiar with the press.

Consistent with my recollection, l am now aware that reviews of the show include such comments about Howard K. Stern (“Howard”) as: her “shifty lawyer” and part of the biggest “freak show on TV.” Another awarded Howard a “Golden Turkey Award” in 2002 and described one episode in which “Smith came off more and more lost and confined, and she displayed roughly the same powers of reasoning and deduction as Sugar Pie the dog.

But Stem, allegedly Smith’s best friend and protector, says it’s all good for her. Sure it is. And Stem isn’t in this for the money.” Yet another stated that upon viewing the show,“it was impossible not to believe that..[she] was under some sort of sedation.” Attached as Exhibit A are true and correct copies of articles regarding The Anna Nicole Show.

53. 113. Why Cosby's Motion for Summary Judgement Will Be Denied - Some Thoughts

• Only a Jury can decide if 'nannygate' is relevant or not to Cosby's 'state of mind'.

Cosby argues that going to The Bahamas after her book was published and after she was sued by HKS does not mean that she had any doubt about the nannies' story and the presence of a gay sex tape of HKS and LB. But, Cosby also says in the same Motion that she is not liable for defamation because most of her book is simply a rehash of 'news' published elsewhere.

Well, Hachette Books' Motion and Cosby's Motion both make it clear that without the gay sex story, the book would never have been accepted for publication. The gay sex allegations had never been in the news previously while the bulk of the book dealt with otherwise well-covered ground. Would a Jury buy Cosby's line of reasoning here?

Where does Cosby show how Clark absolutely convinced her that the sex tape existed? Saying you watched the ANS TV Show and wouldn't have been surprised to learn of a gay sex tape doesn't cut it in the real world. Where is JH to publicly confirm that any of her tales are true? Cosby leaves out the 'public view' that JH was a nut case from the first time she appeared on TV and that JH denied being a source on the day the book was published and then vanished. Cosby leaves out that Clark appeared on TV vehemently denying that he was a source for her book.

Cosby's large number of glib explanations, partial explanations, obvious selection of parts of whole docs that make a different point then the one advanced by her and the lack of explanation for the crucial players and her 'connection' to them makes her Motion for Summary Judgement untenable. A Jury is required to decide if Cosby's notions about societal norms are correct, the characters she has relied upon are actually trustworthy and if her actions speak louder than her words.

Exactly! There is also the fact that those sources didn't know each other.
Bottom line.....the onus is on Stern to prove it is false....which he cannot do.

Rita’s Tape

After the show I listened to Rita’s taped conversation with Lincoln Bain - spokesperson for the nannies. The taped call was per Rita in September.
Lincoln says Nadine saw the video tape of Howard and Larry.Lincoln says he believes the nannies and believes Nadine. So??? Plot thickens…as this tape backs up Rita….tune in Monday to hear entire tape. It is important to hear all the evidence including this tape…
