Spotted: Kelly Rutherford's Divorce Attorney

The woman who plays serial divorceé Lily van der Woodsen on "Gossip Girl" is imitating her character -- she's filed for divorce. Oh, and she's pregnant.

TMZ obtained legal papers filed December 30 in L.A. County Superior Court. Kelly Rutherford is asking a judge to end her marriage of two years to Daniel Giersch, citing "irreconcilable differences." In addition to a child on the way, they have a two-year-old son, Hermés Gustaf Daniel Giersch.

It's Kelly's second marriage, which gives you an idea why she was cast.

31. Even though i feel that breast feeding until the age of 2-3 is alright, i do think there is a limit. 7 years is going a bit far. I think it's really ignorant for people to assume that just because a mother is breastfeeding her 2 year old, she's getting sexual gratification from it. I'm sure there are sick women out there that might do it for that reason, but to say that that is the ONLY reason for doing it is gross and perverted on your part. Being able to breastfeed your child is a wonderful bonding experience. I pity people who have such a warped take on it that they compare it to sucking a guys d*ck. Grow up "Amycat" and educate yourself a little more before putting me down for having an educated opinion.

32. Please this is Hollywood they marry for a couple of days, months and or years and when its not right and they find someone else with mroe money then its bye bye. She is NOT the first nor will she be the last and really who cares if she is pregnant or not she has money and doesn't have to worry. Hollywood is articial flavoring

33. Yes, #23, my story is true. Carlos did die, and he was a wonderful person and friend! There is an entire page dedicated to him on Facebook under the title, "Carlos." He told me that Kelly forced him to do the InStyle special, even though she had left him by that time. Such a sad, sad story. Carlos was one in a million... so much energy with (figuratively) the best heart in the world. He could talk to anyone, and charm an Eskimo into buying ice. A one-in-a-million guy from a terrific family.

34. This is the USA, not Africa. Babies need FOOD after they turn 6 months old. You don't just breast feed after 6 months without giving them food. I don't care what idiotic organization thinks it's OK to breast feed after age 1! Are you kidding me. I mean what do you say to a 3-year-old "hey, come suck on my BOOBS!" I think if you are doing it after 6 months old- then those women just like the nipple stimulation and are insnae- just like that illegal mexican in Bellflower that now has 14 kids under the age of 7, not married, bankrupt, lives at home, all sperm donors. And yes, I am a mother as well.
