"Lost" Star Battles Baby Mama and Gets Kid

Naveen Andrews has just left family court with his son, and the baby mama is sitting on the courthouse steps bawling.

The "Lost" star and Elena Eustache, the mother of three-year-old Naveen Joshua, were in L.A. County Superior Court, where a judge changed the custody order after Elena allegedly took the boy out of L.A. County without permission. Naveen also claimed Elena kept the boy from him.

The parents had joint custody, but today, with the help of disso-queen Laura Wasser, the order was modified so Naveen now has sole physical and legal custody pending a full hearing next month.

We're told Elena has alleged Naveen's girlfriend, Barbara Hershey, practices witchcraft and that Naveen and Hershey have poisoned the boy. In response, Wasser asked the judge to order Elena to undergo psychiatric testing.

Elena brought the boy to court. After the ruling, the bailiff took the boy from Elena and gave him to Naveen, who left the courthouse with Hershey.

Under the new order, the boy is allowed to travel to Hawaii where Naveen films "Lost". He can be accompanied either by Naveen or Hershey.

After the hearing, Elena told TMZ, "I can't believe celebrities and their money. They always get what they want."

46. Really interesting comments. Often, I want to believe the justice system is right but we have seen failures in the past. I can't say on this one either way.

I do believe there are some dads out there that do a much better job at parenting than some moms. I will also say it is in the best interest of the child if they have two stable parents. Unfortunately, that's not always the case.

What's not mentioned in the story is visitation rights. Does the mom have any? Plus, how did it get to this point of custody in the first place? Naveen Andrews has another son who is in his teens. Did he have sole and legal custody of the child? I'm not even sure if that child lives in LA.

As for comments about Naveen and Barbara Hershey living in sin and not being married. If you stand on that foundation, then I would think you would curse Naveen and Elena for procreating without being married.

47. Why didn't this Elena woman admit her mistake to taking the kid beyond the agreement? Instead, by accusing them of poisoning and doing voodoo with the kid, it seems that Elena's true intentions were probably to run off with the kid. Also, if you felt your kid was being poisoned, wouldn't you run straight to the doctors in LA and get him checked out??

49. I don't know why Naveen is so sexy but he IS! Check him out in the English Patient, too. But he's far sexier in Lost. The Barbara Hershey - you have to give her credit. She and Naveen break up for five minutes, he has an affair that produces this boy and she took him back while I think the ex was pregnant. Oh my! That Naveen, too sexy for Barbara Hershey to cut loose long term.

51. I bet alot of you are too young to remember Barbara Hershey. She is at least my age (58) She was very much into the drug culture in the 60's/70's and was either married to or living with David Carradine. (Kung Fu-another wack job.) She gave a magazine interview around then and said that she was walking on the beach and found a dying seagull. She picked it up, it died in her arms, and she felt its spirit enter her body. She then changed her name to Barbara Seagull --no sh--t! The real mother might not by lying about the voodoo.

Because you saw a soundbite with Naveen, that you so clearly remember all these years later, you presume it's some "Middle East" hate he's got going on? 57. Look at that child's face! What kind of judge takes a child from a mothers arms? It looks like these two parents have unresolved issues and again the child pays for it. To Elena and all divorced mothers out there I give this advice. Do not speak ill of your ex or they will take you to court and claim you are trying to alienate the child and the courts will take your child away from you.

59. As much as people don't like the "euromutt" as someone called her, she is the child's mother. She hasn't done anything wrong -- she has not abused her son or tried to kidnap him. In previous stories, it appears that Naveen initially did not even acknowledge that he was with this woman -- he said it was all lies, until a DNA test proved he was the father. Then suddenly, he was interested! He apparently didn't want to have anything to do with the baby initially, so I'll bet the kid doesn't even know him. Good going, stupid idiotic judge -- instead of doing something more reasonable like having joint custody until the rest could be sorted out -- instead just snatch the child, who probably doesn't know this man or his hag, and take him from his mom! And sorry Baldwinistas -- but the mom did NOT take the child out of the state or country -- it was out of the county!! One could drive from Westlake Village to Oxnard and have "left the county", one could drive from Santa Fe Springs to La Mirada and "left the county" -- it's not very far! She was not trying to kidnap him or anything else. And yes, Barbara "Seagull" Hershey (that was her official name change -- to Barbara Seagull) is indeed an ex-hippie whackjob hag! I wouldn't put it past her to be into weird crap. The child is much better off with his mother than with this man who can't control his johnson and his hag who probably worships trees! Just goes to show that money buys judges here in this town.

60. I have to say that I do not agree with the judge's statement. I know the mother and can honestly say that despite how this story makes her seem, she is not crazy at all...and a very good mother. Through my job, I have regularly seen her interacting with that little boy since he was only a few months old. This is very sad news. I can't imagine what she'll do now. That little boy was her life.
She probably only went to visit her family, which I expect any mother who lives in another country away from her own parents would want to do.
Sad, sad.
