"Lost" Star Battles Baby Mama and Gets Kid

Naveen Andrews has just left family court with his son, and the baby mama is sitting on the courthouse steps bawling.

The "Lost" star and Elena Eustache, the mother of three-year-old Naveen Joshua, were in L.A. County Superior Court, where a judge changed the custody order after Elena allegedly took the boy out of L.A. County without permission. Naveen also claimed Elena kept the boy from him.

The parents had joint custody, but today, with the help of disso-queen Laura Wasser, the order was modified so Naveen now has sole physical and legal custody pending a full hearing next month.

We're told Elena has alleged Naveen's girlfriend, Barbara Hershey, practices witchcraft and that Naveen and Hershey have poisoned the boy. In response, Wasser asked the judge to order Elena to undergo psychiatric testing.

Elena brought the boy to court. After the ruling, the bailiff took the boy from Elena and gave him to Naveen, who left the courthouse with Hershey.

Under the new order, the boy is allowed to travel to Hawaii where Naveen films "Lost". He can be accompanied either by Naveen or Hershey.

After the hearing, Elena told TMZ, "I can't believe celebrities and their money. They always get what they want."

76. The birth mother was stupid. Had she followed the rules, and given Naveen access to his son they would not be in court. Naveen has every right to get his son, and it looks like he's the more mentally stable parent. Seriously Elena, get the f*ck over yourself, get your personal and mental life together.

78. We don't know the entire story but let's just hope the judge ruled in the best interests of the child. What bothers me is that some people (many celebrities seem high on the list but perhaps they just get more exposure) treat children like pound puppies. If you're going to have them, be responsible and honor the other parent. Maybe start by not marrying in the first place. We have generations of kids, starting with the boomers and especially post-boomers, who are being raised by two parents in two separate homes or one parent or contentious parents. There is little familial stability nowadays and it's very sad. In the meantime, who knows? Maybe Barbara Hershey put a spell on the judge. She does look a bit scary.

79. In ARAB countries the MEN have all rights over the children and the women have NO RIGHTS.

But this is THE UNITED STATES OF AMERICA!!!!! Why is the ARAB guy receiving full custody in just one short court session with no professional evaluation or anything?! Because she has no money to fight him and he has the fancy lawyers... that's why. Shame on you judge! Shame on YOU.

For the hundredth time, he's ENGLISH, of Indian descent. His CHARACTER on "Lost" is from Iraq. Do some of you think Matthew Fox is really a neurosurgeon, too?

83. You can't make a judgement on this case until we know more facts than what are stated. Why did she take him out of the county? Just because her accusations sound looney doesn't mean they aren't true. What evidence does she present to back them up? How good was her lawyer vs a celebrity lawyer? (remember OJ?) the judge may have been right or wrong. We don't know until we have heard all of the facts, not just a few short bites in on the web.

84. I think the writer of post #8 is showing both ignorance AND racism. Naveen was born in London, grew up in Britain, and both of his parents are from India. He is not from the Middle East. And even if he was, he would be responding the same way I would have to the administration's policies.

85. Just cause a Judge makes a decision...does not ALWAY make it right!! Trust that they are not GOD..and they can be Bought and one sided also..seen it many times here in Canada! Alot of things go on in the court system that people can ONLY imagin! And I have to Wonder..I mean Really..was it in the best interest of the child that the Judge gave the father sole custody?

86. Why is Barbara still with this moron when he CHEATED on her and got this other woman preggers? She is so much older than he is and cant give him children, so suddenly its ok for him to procreate with a younger woman? The poor child would be better off in a foster family than to stay with any of these losers!

88. Ok, let's add this up.....Naveen has been with Barbara since 1999 and his son is only 3, so it's obvious that NAVEEN CHEATED!!! I like him on Lost, but I really am sick of men that can't keep their pants on.....I lose my respect for them.

90. Wow!!! An American court actually treating a father like a real parent. This is the exception that proves the rule. Most courts only see fathers as a fuding source and not a parent.
