"Lost" Star Battles Baby Mama and Gets Kid

Naveen Andrews has just left family court with his son, and the baby mama is sitting on the courthouse steps bawling.

The "Lost" star and Elena Eustache, the mother of three-year-old Naveen Joshua, were in L.A. County Superior Court, where a judge changed the custody order after Elena allegedly took the boy out of L.A. County without permission. Naveen also claimed Elena kept the boy from him.

The parents had joint custody, but today, with the help of disso-queen Laura Wasser, the order was modified so Naveen now has sole physical and legal custody pending a full hearing next month.

We're told Elena has alleged Naveen's girlfriend, Barbara Hershey, practices witchcraft and that Naveen and Hershey have poisoned the boy. In response, Wasser asked the judge to order Elena to undergo psychiatric testing.

Elena brought the boy to court. After the ruling, the bailiff took the boy from Elena and gave him to Naveen, who left the courthouse with Hershey.

Under the new order, the boy is allowed to travel to Hawaii where Naveen films "Lost". He can be accompanied either by Naveen or Hershey.

After the hearing, Elena told TMZ, "I can't believe celebrities and their money. They always get what they want."

91. This really just doesn't sound fair. The judge takes the child away because the mom took him out of the County but, The dad can take him to Hawai. I would also, think it must be very hard for a dad to visit with his son while shooting in Hawai. I think the mother was taken advantage of and the judge should be ashamed of it's self for sperating mother & child.

94. PJF, you are a racist and you are ignorant to boot. Naveen just plays a middle eastern person on TV. In actuality, he is half Indian and half British. I was born in America and I felt the same disgust and anger after Katrina. Does that make me a traitor? Does that make me a terrorist because my skin is brown? 95. My comment is for #8. No, Hurricane Katrina was not a fiasco, it was our govenment's response to an American disaster that was. Not calling you racist, but yes it was totally callous the way the Bush administration treated those people, and yes, unfortunately, many of them were minorities. We have seen them show a quicker response more compassionate assistance overseas than they did for American citizens. Every American's eyes should have shown the same anger. This was not the first disaster area where they gave warning and told people to evacuate, but since I have never been in that situation, do any of us really know how difficult it is to evacuate your home or how expensive it might prove. You may not be racist, but for you to even voice the possibility, gives cause.

97. Is thre a reason we have to CELEBRATE children being born out of wedlock and into broken families? Why does the press use an ignorant term like BABY MOMMA in a headline? I swear, people in this world are getting more and more ignorant every day.Why do people need to use the slang of the lower class as if it's a cool term to use?

98. I think that the judge should have asked the mother what gave her reason to believe that the girlfriend was doing witchcraft around or against her son. I would have had an issue with that especially because I am of another religion and the child came out of me! I would have flipped is the father's GIRLFRIEND, NOT WIFE was given any leeway to take my son ANYWHERE and I wasn't! Was she there during the conception. Hopefully not! I don't see why she was even considered in the scenario between the parents. She should fight it til she wins to get joint custody again! If that was any other ho-joe, the mother would have gotten a slap on the wrist and the girlfriend not even considered. This was like a movie court situtuation. What judge was paid to do this?

99. I find this story very disturbing and I really hope that the court had a legitimate reason for what it did. I do remember stories about Barbara Hershey which portrayed her as being a VERY unbalanced person. As for the claim that Hershey and Andrews were poisoning the child - perhaps the mother meant that they were poisoning his mind against his mother. That happens a lot when couples are fighting for child custody.

On a lighter note, perhaps the judge wanted the child to gain a grandmother - after all Ms. Hershey was born in 1948, i.e. she is coming up to 61 years of age!

100. So she played the witchcraft card. Well I'm no celebrity and it didn't work when my granddaughters mother tried it on us either. Wicca/paganism is recognized in this country and our vets are buried under the pentagram. We won our suit also. She's mad because she wanted to use the child as a tool and Thank the Goddess the judge saw right through it just like ours did. It's time to stop using religion to be petty.

102. For what it is worth, as I understand it: Naveen and Barbara were split up when he hooked up with Elena. So while one could argue that it was poor decision-making to run out and get freaky with another woman in such a manner as to produce a child, if the tales I hear are true, he wasn't cheating, he was rebounding. Different thing.

103. It is about time that a father won custody of his child whle the mother makes up accusations and lies. Looks like the boy is young enough that the mother's manipulation has not branded him for life. The judge was smart enough to see thru the lies and actually do what is best for the child. Great they don't live in TN, , there is no justice in child court there.. The judge there is a joke without laughing.

104. Hmm. This sounds a lot like it has ABOLUTELY NOTHING to do with the public and is a PRIVATE MATTER. I'll never understand why it is that because a person is an actor, singer, etc. we feel that gives us the right to be privy to every minute detail of their personal lives. What's more private than a fight over custody? It is simply NOT the buisness of people outside of the family.
