Model Falls, Gets Up, Files Lawsuit

2/27/2009 10:31 AM PST BY TMZ STAFF

You shouldn't be allowed to sue over a video this funny -- but alas, someone is.

Sarah Welch -- a model and former contestant on "The Bachelor" -- is suing several companies involved with the fashion show she worked at the Mondrian Hotel in West Hollywood on October 18, 2007.

We found the lawsuit -- filed in Santa Monica earlier this month. Welch claims she suffered "great injuries to her body, shock and injuries to her nervous system" after she fell through a hole in the runway which was created by the performer who went on before her.

Welch is suing for negligence and is seeking unspecified damages.

18 months after the fact... this must have been her fall-back plan. Apparently the modeling thing didn't pan out like she'd hoped, so now she goes for "unspecified damages" hoping to win the settlement lottery.

Grammar nazi

What's with the idiot woman who screams the second she falls through the hole and what's with the model standing in a pool of water to the left waving a feathered fan?

THE CHILDREN ARE NOT BEING PROPERLY SUPERVISED...PERIOD!

she should sue, they should have halted the show until that hole was fixed.

I laugh at other's misfortunes

That bitch looked OK to me when she crawled from the hole and walked off. By the way....thanks for the upskirt shot!! You can't sue for public embarassment lady.

Huh?

I hope she wins. Nobody tried to do any sort of quick patch job or at least, something, but that poor girl fell all the way up to her chest and that's gotta hurt.

It is not a funny situation to be in. Let us be honest and fair - just put yourself in her shoes. If it was your sister or wife. Sad - especially after the hole was created by a previous performer. Best would have been to have a person guard the hole or atleast stand near it to direct the models.

She should consider herself lucky that she was able to get up and walk away from the platform. I am sure she will have lasting pain and health problems in the long run. It is better to be safe than sorry.

Before we laugh we should think and ensure that if it was us will we like others to laugh.

Great girl and hope she gets better.

Okay, all you lawsuit happy freaks need to keep it in check here. Modelling IS a job hazard in itself. Granted, it's ridiculous that they didn't patch the hole up, and I'm not entirely against the idea of a lawsuit (as long as she never wants to model for anyone EVER AGAIN, then sue away, because they definitely won't take the risk and hire your sorry ass), but IF YOU WATCH AMERICA'S NEXT TOP MODEL (Thanks for the reference, prior lawsuit happy person), LOTS of things can happen at shoots and on the catwalk that are unexpected and a model has to be tough enough to adapt. Nobody's line of sight is that bad that they couldn't have seen that hole, she just didn't (or was too nervous to) look. Anybody who says a model doesn't look down the runway is full of it. They just can't look DOWN...no obvious glances, but you bet your heinie they look ahead to see where they're going. If they didn't, can you imagine how many models would fall off the side or the end? That is preposterous to say they don't look. Also, can you imagine Iman, Gisele Bundchen, Heidi Klum, any of these women suing because they fell? Probably not. Go Google models falling or supermodels falling, and see what happened there. I'm just sayin'....

OK, I am not one for people filing frivolous lawsuits but someone dropped the ball here. Models do not look down when they are on the runway so who ever was in charge of that particular show should have stopped it long enough to cover up the hole in the floor. I am sure this woman suffered some sort of injuries dropping that far through a hole. At least the male model had enough common sense to stand there so no one else was injured.

I thought at first that it was just a piece of black fabric from the performers outfit. Even with the close up I did not see it was a hole. My goodness that was complete neglegence on everyones part. The fact that no one not even the audiance said something is rediculous. It was like someone wanted to see the disasterous outcome. Yes it was funny to see her just plop right in the hole but my god that had to hurt. What a shock to the system for sure! I'd be pissed hurt and sue too!!

I hate people that are sue happy, but the people coordinating the fashion show knew that was there. Why would they let the models still walk on that? Plain stupid and she is completely right, NEGLIGENCE on their part.
