Brown Wants Misdemeanor Plea, No Jail Time

Chris Brown ExclusiveSources tell TMZ Chris Brown would cop a plea, but only to a misdemeanor and with no jail time. After we broke the story yesterday AM it has triggered a passionate public reaction.

We're told Brown's people have consulted with outside legal eagles -- including law school professors -- who have said Rihanna's own aggressiveness takes it out of the felony category. Sources say Rihanna was the first one to strike -- slapping and striking Brown "numerous times" while he was drivΩing, after seeing the text message from another woman. And Rihanna was fighting Brown as he punched and hurt her. We're told much of this is reflected in the official police report based on what Rihanna told cops. As a result, they say, this is not a case that demands a felony plea.

On the other side, there are plenty of cases in which the woman engages the man in a fight but the jury convicts the male because it was an unfair fight and the man could have walked away. The photographs of Rihanna -- the most graphic of which have not been seen by the public -- demonstrate Brown's superior strength. Add to that the fact that Brown had no significant injuries and it presents problems for him.

Perhaps worse for Brown, sources tell TMZ Rihanna told cops he had beaten her before and the violence had been escalating.

And there's this. According to the detective's note filed with the search warrant papers, Brown sent a text message to Rihanna's assistant in which he apologized for what he had done to Rihanna and said he was getting help. That would be admissible in court and extremely damaging -- as a legal admission.

The problem is with any self defense, you cant use excess force. Its like hitting someone with a slipper and in self defense you shoot them, it doesnt work that way. What the courts are going to say is that Chris Brown had the strength to hold her back or not use the strength he did. Even if Rihanna was violent, unless she grabbed something to hit him with then he has no excuse for what he did to her,

47. well their days of squeaky image is over. if she thinks for a second it won't happen again, she's wrong, wrong, wrong. especially since she's shown herself to be an instigator. I have yet to meet a guy that won't go ballistic when he's attacked.

oh well, she was warned. I guess this is one of those Darwin moments.

49. Chris Brown should be chained to the bumper of a car driven the same route he beat Rhianna, unchained and lynched. Yes. Lynched. Then he should go on trial for the violent crime he committed against Rhianna. Violence is a deterrant for future violence.

53. No way. Geragos can't take this case to a jury, and he knows it. He's trying to scare the DA into a STUPID deal. Forget it! This two bit THUG went out PARTYING the night after court. He WAS NOT at any business meeting until 3:45 a.m. That is admissible, as is the evidence the THUG waited NINE DAYS to apologize. Don't drop the soap in PRISON thug.

Ok.....April you are not making any sense...you are saying that it is ok for Rihanna to strike Chris who was driving the car at the time...which is Reckless Endangerment....and the fact that she can swing at Chris like that with no fear shows that she has been doing this before..... I STILL DO NOT CONDONE CHRIS BROWNS ACTIONS......he should have been smarter with his reaction...however both of them need to go to couples counceling(Since they are married now......SMH).....Chris get away while you still can...its a TRAP....Rihanna seems like the controling type of woman....and that Plea deal seems fishy......

58. This is ridiculous. Why would any lawyer consult with "legal eagles" to know if an act is a felony or a misdemeanour ? A first year student could answer that question simply by analyzing the former decisions of the judge who will be in charge of the case. This is a false information probably advertised by Brown side to make him look more like a victim. I don't know what his degree of guilt is. This story doesn't really interest me. What irritate me is disinformation.

59. This coward will get no jail time. A slap on the wrist, with probation and maybe some anger management classes is all he will likely get. He deserves to go to jail, whether Rihanna struck him first or not. I am sure he didn't look bruised, bitten, and bloody like she did. He sucks!

Some legal analyst said if Rihanna didn't testify against him, that the charges would be dropped, or the case dismissed. She won't testify against him. They are back together and she is an IDIOT!
