Ed McMahon Deposition -- Pain in the Neck

Ed McMahonEd McMahon is dealing with a life and death struggle with bone cancer ... now there are new legal issues he must deal with.

Ed is suing Cedars-Sinai Medical Center in L.A. for allegedly misdiagnosing a broken neck. Cedars wants to take Ed's deposition. If Ed doesn't sit for his deposition, his case can be thrown out of court.

In legal papers filed with the court and obtained by TMZ, Ed's lawyer wrote a letter to the Cedars' lawyer saying Ed would be available for a depo, but it would have to be taken at the UCLA Medical Center because that's where he's been bedridden in ICU for three months.

The letter states, "He is not able to leave his hospital bed. Please suggest appropriate dates next week. Please be advised that Ed remains in ICU so medical precautions will be necessary at the direction of the attending UCLA staff."

22. Well for hell sake, I had no idea he's been in ICU for the past 3 months and dying from bone cancer (frown). And by the way, I voted for Obama and I have a ton of compassion!!!! I'm sorry to say the inevitable will most likely happen, he will succumb to his illness long before his case goes to trial. Cancer is a ravenous disease (especially bone) and at his age, my guess would be at best he may live a total of 6 months. I shall hope his pals Johnny and Jerry give him a proper Hollywood burial.

24. Cedars is a disaster. You only hear about the celebrities they screw over. They screw over non-celebrities too with malpracticing doctors, HIPAA violations, and loony staff. They don't care about rectifying the deficiencies, only about skirting responsibility. Read your bills carefully, too.

FYI, litigation is NOT the cause of high health care costs. That is a stupid fallacy that should STOP being repeated by idiots who don't know the facts, or who have an agenda.

Actually the medical field is a gangster system with little accountability of doctors/hospitals. The deck is stacked against consumers for suing unless you are a person of resources.

Do not sign binding arbitration agreements, people. If a doctor demands one, he is suspect. Binding arbitration allows them to keep all their malpractices a secret, and you lose your right to a judge and jury which is what they want. Doctors who demand one have something to hide. This is the bottom line despite all the baloney arguments doctors will try to bs you with.

Arbitrators side with doctors because it's the malpractice insurance companies that keep arbitrators steadily employed. Who would you side with? The companies that keep giving you jobs, or some random consumer you'll never see again.

Doctors are used to owning the system and resent anything that creates more transparency.

Go get 'em, Ed.
