Howard K. Stern, 2 Docs: We're Not Guilty!

Howard K. Stern and two doctors, Khristine Eroshevich and Sandeep Kapoor, just pled not guilty to a pile of charges in the Anna Nicole Smith drug case.

The dynamic trio have each been charged with 6 felonies -- after a massive investigation that led prosecutors to charge that they funneled drugs to Smith in the years leading up to her death.

All three defendants had no problem with giving the D.A. handwriting samples that cops could use in determining who signed what prescriptions.

You are wrong. Texas would not have spent over one million dollars of
a law firm's money to try to get Howard out of the way if there was
really no M. $.
You need to read the Estate Will, HKS is NOT SPENDING ONE CENT OF
THAT CHILD'S MONEY!
Any money so far that the baby has is from the appearances that the
executor and her legal guardian have go for her.
Anna did not have very much to leave her child, HKS & LB have made
the child's estate have more money than it was.
You need to grow up, and quit calling my opinion pathetic, because we
could all say the same about your opinion.

18. Let's face it, she was an addict. Everybody knew it. The drs. should have their license taken. They knew she was abusing and chose to send her drugs anyway. All Howard was, was an enabler. It worked to his advantage for Anna to be toasted most of the time. So of course he helped in getting her what ever she wanted, cause in turn, he got whatever he wanted.

19. Justme, you're an idiot. They may not have purposefully done Anna any harm, but they supplied her with massive amounts of drugs that shouldn't be mixed. They knew she was abusing and did nothing but send her the stuff that killed her. I don't care if Anna was calling the shots, if those people really loved her and cared about her, they would have tried to get her some help. They're drs., they knew they were hurting her and not helping her.

22. The doctors should most definately be prosecuted. They wrote scripts in massive amounts ( above and beyond the usual adult dosage) and in false names, which is a crime in all 50 states. HKS not only called for these scripts, but picked them up, knowing they were in different names, including his own. That my friends is a crime.

LOS ANGELES (AP) - Anna Nicole Smith's lawyer-turned-boyfriend and two doctors pleaded not guilty Wednesday to charges they conspired to provide thousands of prescription pills to the former model before her overdose death two years ago.
The appearance of Howard K. Stern and Drs. Khristine Eroshevich and Sandeep Kapoor in Superior Court set the stage for a preliminary hearing that all parties said could last at least two weeks.
Deputy District Attorney Renee Rose said there are 1,400 pages of discovery in the case, which was investigated for two years before charges were filed. Court Commissioner Kristi Lousteau ordered documents in the case sealed although attorneys said that about a quarter of the material has already been made public.
The hearing was brief and Smith's name was never mentioned.
Stern, Eroshevich and Kapoor stood before Lousteau with their lawyers. The defendants said "yes" when she asked if they were pleading not guilty and when they agreed to delay the matter until June 8 for setting of the preliminary hearing date. They declined to comment outside court.
Stern's lawyer, Steve Sadow, said he wanted the preliminary hearing to begin as soon as possible.
The commissioner granted a motion requiring each defendant to provide a handwriting sample and she transferred the case to a judge for the next hearing.
Outside court, Stern's lawyer was outspoken, exclaiming: "He did not commit a crime, period!"
Sadow said he had filed a demurrer, a legal document contending that the law under which Stern is charged does not apply to him.
"The statute deals with medical practitioners," he said. "He is not a doctor."
Kapoor's lawyer, Ellyn Garafalo, said he continues to practice medicine and his patients have been supportive.
"We have no doubt Dr. Kapoor will be exonerated," she said.
Smith, 39, was declared dead at a hospital after being found unconscious in her Florida hotel room in 2007. A medical examiner determined she died of an accidental overdose of a sleeping medication and at least eight other prescription drugs.
Prosecutors allege Stern was the principal enabler in a conspiracy to provide Smith thousands of prescription pills.
The defendants each face six counts including conspiracy, and up to five years, eight months in prison if convicted.

26. Anna Nicole was purposely kept physically and mentally incapacitated to the point that she had NO control over what was being done to her...
When you're virtually comatose, it's hard to prevent someone from popping a syringe in your ass, or slipping you a mickey...
Her condition in the video footage that was taken during her pregnancy speaks volumes...Not only was she intoxicated, but some idiot found it amusing enough to record the episode...This same person had an OBLIGATION to report the dangerous behavior to authorities, especially since Anna Nicole was pregnant, but chose instead to become complicit in the criminal acts that took place that day...
Many people involved in this fiasco are equally guilty of contributing to her death, and they should ALL be held accountable...

27. Arraignment of HKS/K/E 5-13-09

• United in a common defense - the truth

All three affirm pleas of ‘not guilty’ and as HKS’s main Attorney Steve Sadow stated after the proceeding:

"Every one of the people in this case contends that there was no crime, because in fact, there was no crime."

Sadow provided the insight that he will issue a general demurrer in this case should a preliminary hearing not be successful in having the charges dismissed. 6-8-09 is the day the Court will set a date for a preliminary hearing. A general demurrer would state that even if the acts charged, as written, were all true, those acts do not amount to a crime. This has been discussed at length on previous threads. City Prosecutor Renee Rose opinioned that a preliminary hearing could easily last two weeks – no doubt!

• TX cabal-related docs to remain confidential by Court order for now.

An astounding revelation today was that a 1400-page brief exists for these charges and that some of its contents relate directly to ongoing ‘Smith-related’ cases in NY and TX. We know that material has been funneled by the O’Q/VA operatives from the Cosby and ‘bloggers’ lawsuits and that this material can only be the lies, rumors and innuendos that the TX cabal has defamed HKS and others with for over two years.

More indication that the politically active AG of CA has been suckered into charging people with crimes that don’t exist at the urging of outside agitators with their own nefarious purpose. More indication that HKS/K/E have been targeted for criminal prosecution based on peculiar moral considerations that have no place in the Court room; exemplified by JB’s early derogatory use of the non-legal term ‘chief enabler’ to describe HKS.

• Release the 1400-page brief!

The Cosby and ‘bloggers’ cases are toast, as we see proof that the defamation from Cosby and VA’s people continues; time for the media to inquire with renewed interest what the connection between these two civil cases and the CA criminal case is.

28. If any of you heard the live feed, it appeared to me that HKS' lawyer-man just threw the DR.S UNDER THE BUS ! Stating that HKS is no DR> and the thingy they're charging HKS with is a DR.S' whatchamacallit. The look on DR.SANDADEEP's face says it all.

So here how it will go down, unless the PROSECUTION does some major damage control, is that the DRS. will go to jail, and HKS will be making a A LOT OF NEW ENEMIES in so doing.IMO

30. Just me you are right, that Marshall money will go to the baby, it may take some time but that case started before Anna died and it has to be played just as if she was still alive.

DonnaG- Immorality is not illegal. Stern will walk, he had no legal control over what she did as an adult. He did not write the prescription, if they were in his name and she took them without his "knowledge" he walks. Anyone can pickup your prescription from the pharmacy. Now the Dr. that's a different story but I am sure she has records that indicate diagnosis that required them. If so, it would have to be up to a medical board to determine if it was excessive or medically necessary. Those arrest are grandstanding by the DA trying to make a name.
