Britney Spears is being sued by the photog who got run over ... and we got the whole thing on tape.

Rick Mendoza was a casualty of Britney's Mercedes as she was pulling out of a Beverly Hills parking structure in 2007.

In his lawsuit, Mendoza says Britney's people -- who are also defendants -- "should have known...Britney was not in the mental, emotional and/or physical condition to operate the subject motor vehicle in a safe and reasonable manner."

She ran over his foot ... and it did look painful.

168. ROFL, oh come on. I thought it was actually simple. You go in front of a moving car , you get ran over, ain't that what parents teach us when we're young? That and look both sides of the road. Because she's a celebrity we're suppose to believe he can put his freaking feet in front of the car without being hit? That's a joke, that's really a joke. Leave the girl alone, DAMN! I bet he did it on purpose to make some extra cash........ yeah I bet he did.

169. I dont think she should be sued cause that man was probly trying to snap a pic of her with out her knowing. It did not have anything to do with her being unstable. And honetly i really dont even like britini that much maybe a couple of songs but other than that nothing. But even i can see what this man is trying to pull.

170. Actually I used to know Rick very much. I met him in Los Angeles and he was not a paparazzi at that time yet.
But all I can say is he is very greedy and totally self-centered. He yells at people even his girlfriend like crazy.
I hope people don't trust him. He is really greedy.
