Britney Spears is being sued by the photog who got run over ... and we got the whole thing on tape.
Rick Mendoza was a casualty of Britney's Mercedes as she was pulling out of a Beverly Hills parking structure in 2007.
In his lawsuit, Mendoza says Britney's people -- who are also defendants -- "should have known...Britney was not in the mental, emotional and/or physical condition to operate the subject motor vehicle in a safe and reasonable manner."
She ran over his foot ... and it did look painful.

I'm not a huge fan of Brittany but this is some BS. He should have move out the way. He seen her trying to get out of the parking lot but he stood there taking pictures and get his foot ran over. I think he should not get any money because he walk off fine and no one call the police when it happen! Brittany should have to go to defense driving school and/or something else. Good part about the driving school she'll save money on her car insurance LOL!
