Britney Spears is being sued by the photog who got run over ... and we got the whole thing on tape.

Rick Mendoza was a casualty of Britney's Mercedes as she was pulling out of a Beverly Hills parking structure in 2007.

In his lawsuit, Mendoza says Britney's people -- who are also defendants -- "should have known...Britney was not in the mental, emotional and/or physical condition to operate the subject motor vehicle in a safe and reasonable manner."

She ran over his foot ... and it did look painful.

17. It was Mendoza's own fault - the risk he takes by jumping out in front of a moving car in order to snap a pic. Perhaps he should have instead filed a Worker's Comp claim.

21. how does that happen? the photog didnt realize a car was that close to his foot?! i think he pretty much took the risk when he started to crawl all over a MOVING VEHICLE.

The whole reason he was there, rubbing up against Britney's car, was to take full advantage of the publicity that he is now arguing should have led Britney's 'People' to a place where they "should have known...Britney was not in the mental, emotional and/or physical condition to operate the subject motor vehicle in a safe and reasonable manner." - Why isn't he responsible?
