Britney Spears is being sued by the photog who got run over ... and we got the whole thing on tape.

Rick Mendoza was a casualty of Britney's Mercedes as she was pulling out of a Beverly Hills parking structure in 2007.

In his lawsuit, Mendoza says Britney's people -- who are also defendants -- "should have known...Britney was not in the mental, emotional and/or physical condition to operate the subject motor vehicle in a safe and reasonable manner."

She ran over his foot ... and it did look painful.

47. I agree with most of your coments that he is an idiot but if Britney is smart she will counter sue. somethink like it was his camera flash that temporarly blinded me causing the accident thus causing me to feal really bad this ultimetly led to my menal health problems.

48. The case should be thrown out immediately, what do you expect when you stand in front of a moving vehicle holding a camera not paying attention to anything BUT getting that money shot! He seemed perfectly fine walking away but we all know it’s not about that; just looking for another way to make a quick buck…

52. Just amazing! If the moron had not been too close to her car he would not have been run over. He has no case! This is just a waste of time and money for the court but some lawyers will make some money off of it I guess.

53. Sorry but that's what happens when you get to close to a car, idiots! I mean come on why do you think mothers tell their children to watch for moving cars and never to get to close to one. I am sorry but I DO NOT sympathize with the photog, that's whay they get for being in the way. I mean dude wouldn't move, hell and u don't want to wait forever if u have places to go! Geez! If that's the job u choose, learn to deal with the consequences when u get to close to a celebrity car trying to get the "good" pic.

58. I wish the judge would have the balls to not only throw this suit out, but to also make the photog pay for all the court and legal fees, charge him with filing a frivolous lawsuit, AND pay Britney for pain and suffering.

I seldom EVER side with the Hollywood Primma Donna's, but this guy stuck his foot under the freaking tire of a moving vehicle. I think they should be allowed to run these paps over that think they can illegally detain people so they can get their shot.

In a world where you don't think the paparazzi could possibly get any scummier, here this guy comes to prove they can.
