Asian Suing Miley Delivers Kung Pow to Judge

So you're suing Miley Cyrus, claiming she defamed 1,000,000 Asian Pacific Islanders in L.A. County by taking a picture while making squinty eyes ... so how do you gain favor with the judge -- call him a racist.

Lucie Kim and her lawyer, Henry Lee (not the OJ Simpson forensics dude Henry Lee) claim the judge crossed the line in a hearing last week by repeatedly referring to Asians as "oriental." They say the word "oriental" is "an offensive, derogatory racial insult to persons of Asians descent ... akin to using the word N---er.

Kim and Lee want Judge Robert Hess to remove himself from the case.

31. Hello, if you look it up in the dictionary you will see:

–adjective
1. (usually initial capital letter) of, pertaining to, or characteristic of the Orient, or East; Eastern.
2. of the orient or east; eastern.
3. (initial capital letter) Zoogeography. belonging to a geographical division comprising southern Asia and the Malay Archipelago as far as and including the Philippines, Borneo, and Java.
4. Jewelry.
a. (usually initial capital letter) designating various gems that are varieties of corundum: Oriental aquamarine; Oriental ruby.
b. fine or precious; orient: oriental agate; oriental garnet.
c. designating certain natural saltwater pearls found esp. in the Orient.
–noun
5. (usually initial capital letter) a native or inhabitant of the Orient.

Look at #5 in the noun version, so people need to go back to school a little bit I think!!!!!
The only reason this person brought this up was because they know they are going to LOSE this lawsuit. It's ridiculous and in no way an insult or akin to a racial remark. The term has been used for centuries and by people of oriental descent also. Most of them are proud of their heritage obviously the person in this lawsuit is not!!!!

32. The orient is comprised of a significant portion of the Asian continent (generally, the southeast). It identifies nations/regions where people of the obvious ethnic decent originate from. There is nothing derogatory about the term "oriental." To call people of this ethnic decent "Asian" is to call them by the same same as all "Asians" (Russians, Indians, Pakistanis, etc.). They are clearly not of the same ethnic background, but all live on the Asian continent.

35. Since when is it actually illegal to be racist? I mean if this is actually true there are potentially millions of lawsuits out there just waiting to happen. What a load of crap this is.

36. OMG!!! LOOK!!! I am making squinty eyes. Come, take my picture, publish it and sue me! Oriental is NOT the same as using the "N" word. GOOK is the same as using the N word, Lucie. You should know that, at least if you are even a quarter as educated as you clearly believe yourself to be. There are restaurants who still push the Oriental Chicken Salad on a regular basis. It is not a Japanese Chicken Salad, nor a Korean Chicken Salad. It is NOT offensive. Coming from someone who is from 2 very different nationalities that are frequently the butt of jokes -- get yourself a real job, an apartment and a life and STAY HOME. You do not need to clutter the judicial system with worthless cases.

37. Some thoughts:

1. Don't tell me, as an Asian person, what I have the right to be offended to. That's incredibly arrogant.

2. The term "oriental" implies, to quote a pro-Cyrus person that someone is "exotic" and foreign. Asians have been stereotyped as especially foreign for a long time. This has lead to very real consequences. The Japanese internment was based on this racist idea that the Japanese were unable to assimilate, as opposed to Italians and Germans in America.

3. "Oriental" refers to things. Asian refers to people. When you decide that Asian people are "Oriental," you de-humanize us.

4. Law suits that involve racial discrimination claims (whether you agree that this case is legitimate or not) give a non-violent outlet for anger. Repressing anger is not good.

5. Many people who are upset by the law suit have responded with hateful remarks towards Asian people. If you disagree with my or Ms. Kim points, discuss our individual points. Do not attack the entire Asian race as if we all act and think the same way.

6. Many who disagree with the lawsuit have decided to use "oriental" to characterize Asian Americans ... likely to demonstrate how they disagree that it's racist. Manners would dictate that because you know it's offensive, whether you agree that it's racist or not, you would not use that term anymore.

43. Oldblue -- people from Italy and people from Finland have clearly different ethnicity, yet they are all European.

Oriental is not equivalent to the "N" word, but it is equivalent to Negro or Colored. It may have been appropriate or normal 40-50 years ago, but today it is archaic, and yes, if used today, clearly wrong.

I don't agree with suing someone for being racist, unless they are promoting violence maybe, but they are right about use of that word by a judge. Can you imagine a judge sitting behind the bench and repeatedly using the word "colored" in reference to a person? Wouldn't happen!

45. This is STUPID.Why don't we have laws that will make someone bringing a frivolous case have to pay BOTH sides. They do in Europe and it curs down on these stupid cases. Lucie needs to get a job and make her own money. And her lawyer needs to be ashamed of himself. And oriental oriental oriental. How silly of a person is this Lucie. Oh you hurt my feelings. Grow some thick skin honey it's going to be a long hard life other wise.
