So Shoe Me -- Van Halen Takes Nike to Court

Eddie Van Halen claims Nike is guilty of walking all over him -- by saying the shoe giant jacked his trademarked black, white and red design for a new line of sneakers.

ELVH Inc. -- Eddie's company -- filed a federal lawsuit against Nike last week, laced with allegations of copyright infringement. The suit claims a series of designs Eddie trademarked -- designs which have prominently been displayed on his guitars since 1978 -- were lifted by Nike without his consent.

The suit is not only seeking monetary retribution -- it also calls for "the impoundment and destruction of all footwear."

31. 16. It's TRADEMARK infringement not copyright. Also, whoever said the design isn't original- if the USPTO (United States Patent & Trademark Office) deemed it original and thus issued a trademark registration (as the story indicates), then in the eyes of the courts it IS an original, protected design.

Uh..not really. Many trademark registrations are deemed invalid when the dispute reaches court. The only thing a USPTO registration means is that in the eyes of the USPTO registration is proper. The USPTO has no power to issue injunctions or other orders.

32. Nike stole his trademark, The pattern looks exactly the same, and if you are a Van Halen fan, you would be compelled to buy the shoe for that very reason. Nike, Nike, do you not make enough money of those $2.00 shoes that are made in China?

35. You don't file allegations of copyright infringement for trademarks. More likely ELVH got a copyright for an original work of art, NOT a design trademark. USPTO database seems to back this up.

42. FACT: Eddie Van Halen stole the song "RIGHT NOW" from a couple of no-name Chicago songwriters. The Chicago songwriters sued, and Van Halen settled out of court for a undisclosed sum (it was chump change). The Chicago guys lawyer didn't want to battle Van Halen and their record company so he convinced them to take the deal.

I used to hear these guys rehearse and heard them play RIGHT NOW all the time. When I heard Van Halen's version of it on the radio, it was astounding how little they changed it. How F'n arrogant!
