Both passenger and driver knew what could happen that night and I feel pretty certain that the accident wasn't intentional howver, his driving privelages should be taken from him for a long time.

Whamo get your facts straight. I don't recall the news stating that this idiot was "impaired". He was just being a stupid kid who was given a very fast car and felt like racing it down the street.
