Debbie Rowe --

She Gets Custody if She Wants

6/26/2009 12:52 PM PDT BY TMZ STAFF

Debbie RoweDebbie Rowe is poised to take full custody of the two children she bore for Michael Jackson.

It has been widely reported Debbie Rowe gave up her parental rights to Paris and Michael Jr. That is not true.

During the custody fight that Rowe had with Jackson in 2005, she attempted to give up her parental rights, saying Michael was the greatest father ever. Retired Judge Stephen Lachs, who presided over the hearing, initially ruled her rights were terminated ... but then Lachs reversed his decision.

Here's what happened. We spoke with Lance Spiegel, the lawyer who repped Jackson at the time. Spiegel says under the law, the Department of Children and Family Services must conduct a parental fitness investigation before parental rights are terminated and that didn't happen with Rowe.

So Rowe has never given up any of her parental rights. As a result, under California law, Rowe is now presumed to be the person who will get custody. The only way Rowe can be denied custody is if a court determines it would be "detrimental to the children."

As for whether Rowe will ask for custody .... our sources say you can bet on it. We're told if Rowe gets custody she will get "a huge amount of child support from Jackson's estate."

Can't you see for yourself? This woman is NOT mother material. She only had those kids to make money and line her nest for life. Poor little things.....and what about the youngest one? Is he going to be torn away from his siblings?

Those kids have no clue who this surrogate mother is!!! And what about poor blanket? Should he be once again be seperated from another family member so soon after losing his dad? Debbie got paid to get lost and thats how she should stay! She is only in it for the money anyway. They should stay with Michaels family. This whole thing is so sad. But knowing Michael he has another ace up his sleeve where these children are concerned. You can bet he has made some iron clad arrangements for his kids in his will!

even though Debbie is probably just in it for the money, who else should get the kids? Michael's family is disfunctional, like him from what I've seen. Especially if the kids were not fathered by MJ (which they are absolutely too white for that to be true), they should go to the biological parent unless she is just not capable herself. MJ great talent but totally messed up in the head. Hate to say it but this situation might save them being molested. still, a sad, sad, situation.

I have two adopted daughters. If something happened to me, should they go to their birth moms because they gave birth to them? Hell no. My parents would get them. They may not have been his biologically, but they were his legally and that has to speak volumes to any court. As I stated, giving birth doesn't always make you the better parent. How many women do you know that you've honestly sat back and said "Why in the world does she have children or why hasn't someone taken her kids yet? " I have a cousin that has had 13 kids and GAVE them ALL to the state because she didn't WANT them. Should she get her kids back just because she had them? People need to step back and realistically think about things. I teach and I see lots of fathers who were actually the better parent.
