There are reports that Michael Jackson's will says the singer wanted his mom, Katherine, to get custody and wanted assets to be placed in trust.
The will, according to the AP, lists Jackson's lawyer, John Branca, and John McClain, a music exec, as executors.
The will has not been filed with the court.
As for custody -- the will does matter, but ultimately the decision on who gets custody is in the hands of the judge.
46. Ok, people are attacking Debbie Rowe without even knowing her side of the story. Let's just say she was the surrogate for Michael. Back then Katherine insisted that they marry. She doing what she and so many others have done. She was being a surrogate. Unfortunately, she became highly recognized. I don't know any other surrogates that are being told they have to take responsibility for the chldren they carried due to a contract. Let's not make it difficutl for others who pursue surrogates. What would happen if something happened to the Brodericks in which their surrogate just gave birth to twins? Would the surrogate be forced to take custody or have to feel guilty because she spent so much time trying not to become attached to only be ridiculed for doing so. Come one! We keep hearing all this stuff about Debbie Rowe from everyone but Debbie. Let's not just assume the worse of her. I once heard it be said that although she and Michael had an agreement, that she really cared about him.She too is grieving. Don't just hang her cold and dry and assume she sold her children. She may only be guilty of helping someone have children. You know, like so many surrogates have done for so many others.

51. ENOUGH already. These children have lost the only parent that they have ever known. And yes if you look at the birth certificate MJ is named the father so there was no need for him to adopt. He was their legal father. Everyone needs to stop all of the craziness and let his children bury THEIR father and mourn in private and peace. That is what MJ would want for them. Joe Jackson needs to crawl back in the hole he came out of and take Al Sharpton with him. Only took 2 minutes of him talking to see what he is all about. Seems to be street and not very educated. And it's great that all his assets will be held in a trust. That way, NO ONE can touch the money except for the children when they are old enough.
AND EVEN THEN it'll be hard for anyone to take all the money. Sure, they'll have their spending accounts and what not, but no one will take it away from them.
I'm happy that Katherine will be awarded custody, so long as Joe Jackson does NOT live with them in Encino. They'll be brought up in the same house Michael spent much of his youth and adulthood until he purchased Neverland.
