Man Claims He Got 'Lost' First

7/13/2009 6:20 PM PDT BY TMZ STAFF

There may be one human being on Earth who understands the TV show "Lost" -- a guy who claims he created the show 32 years ago.

Lost Click to view!

Anthony Spinner -- a producer on "Baretta" and "Babes in Toyland" -- says back in 1977 he was paid $30,000 to write a TV pilot, which eventually became a 121-page script called "Lost."

Spinner is now suing ABC and Touchstone Television, claiming the network passed on the show in '77, '91 and '94 ... then suddenly created an exact replica with Touchstone in 2004.

Spinner lists a ton of similarities in his suit -- which was filed on July 10 -- notably an "airplane headed to Los Angeles [that] crashes into a tropical jungle-like environment."

Spinner also alleges the new "Lost" characters -- including Jack, Locke, Sayid, Kate and Sawyer -- are all rip-offs ... down to their occupations and dark pasts.

The comparisons go on and on. Spinner is suing for damages and a cut of royalties, profits and a bunch of other stuff. Spinner tried to sue a few years ago, but it was dismissed for procedural reasons.

Limitations on cause of action arises where too much time has elapsed. as it stands, the cause of action was initiated when Lost came out and is still in existence. However, the Da Vinci code debacle with the Authort of HOly Blood, HOly Grail (Leigh) had to eat humble pie. Just pointing it out!

Sounds like he he's been ripped off indeed, and he did indeed wrote LOST. Is this why LOST is going to end I mean I have not seen it anymore but heard they stop. Could this be the reason? Anyway I hope Spinner wins he has prove so the other loose. I do hope Spinner brings a new sort of LOST he can writes so it should be no problem then.
Best of l;uck Spinner.

For those saying 'why now?'
ummm.. have you ever had an attorney?! Damn, you are lucky if they return your calls this decade.

If you actually read the article, you'll see that he did file before, and it wasn't dismissed entirely. This has nothing to do with waiting to see it was a success. It looks pretty convincing to me, Lost could be in trouble here.

It should be expected. Is anything on TV original?

It takes years and years to build a case and have a proper lawsuit with evidences and all that works.

Fan Since 2007!!!

intrigued #59,

Thanks for the heads up. I'm so glad someone else remembers it but wasn't sure about the earlier date as opposed to "Lost". I can see how Spinner could've been inspired by "Lost Flight" just like I was so many years ago. Thanks again!

Man those green highlighted keywords are annoying...

Is it just me, or are a lot of those similarities not actually accurate? A bunch of that stuff didn't really happen on the show the way he wrote it.

It's obvious this guy contorted his story to make it fit within the script of Lost. If you look at the similarities, he lists one character as being similar to about five Lost characters. Also, a sabre tooth tiger and a polar bear? Those are completely different directions. Talk about grasping at straws.

Other than that, he listed very basic character archetypes as his similarities, and basic plot devices. The concept of getting stranded on an island is not new. The concept of natives is not new. Booby traps are not new. Flashbacks are not new. You know what other show had all of those? Gilligan's Island. Whoops, guess that's another lawsuit.

Anyone with any familiarity with the show will tell you the things that makes Lost the show that it is aren't the stock things this guy is listing were stolen from him, and that the show, in its current form, is incredibly different from whatever this guy's script was. I'm looking forward to this guy getting 'kthxbai'd" out of court.

I have been there

Anthony Spinner has a legitimate Hollywood track record. My best guess is that he wouldn't sue unless he had a real case.
