77. @MacConvie: Only the DA's office can file criminal charges and they've chosen not to do so due to no evidence of Brandy having committed any crimes. Any moron has a constitutionally protected right to their day in court, regardless of the lack of merit of one's claims. Settling a claim is usually a business decision - not an admission of guilt. Say it would cost $100k to pursue a trial to conclusion as a matter of principle, but you could settle it for a fraction of the cost in a fraction of the time; most people value time and money more than principles, so they'll usually settle. Doesn't mean squat though.

The dead woman hit someone else first because she was high and stupid. She caused the original accident which took place immediately in front of Brandy. Brandy's vehicle, meanwhile, had nowhere to go but to hit this woman's car. You can bend or break the laws of the State of California all you want, but you can't break the laws of physics. Yes, it's tragic. Yes. the dead woman's family grieves her loss. Yes, people need to be attentive to their surroundings. But people also need to abstain from operating a motor vehicle when they're under the influence of an illegal drug which has been proven to adversely affect one's motor skills.

It was the dead woman's fault, plain and simple. You can't just jump to the dead woman's side just because she's dead. The "bleeding heart" defense doesn't hold up in court. The dead woman had the greater duty to her fellow motorists, a duty she breached at the cost of her life.

78. See what happends when you are drinking or talking on the cell

79. Brandy's only "crime" was that she was driving too close to a car that stopped suddenly and caused a chain reaction involving many cars. Brandy's car rear-ended the woman and she over-reacted and drove into the path of another car head-on--that's the car that killed her. Brandy was not drunk nor on a cell phone. Her own car was struck from behind also. Matthew Broderick killed a woman and her mother because he was confused on British roads and was driving on the wrong side. Two members of a family--not an entire family. He fulfilled a plea deal with the British courts. Rebecca Gayheart was not charged because the kid ran out into the street (he was unsupervised) and the accident was unavoidable--and she stopped to give aid--not a hit & run, not on a cell phone, not drunk. Halle Berry was charged with the accident she was involved with and accepted a plea deal. Broderick and Gayheart did not have enough clout in their careers to warrant "special treatment" at the time of their accidents. All of these celebrities are haunted by what happened. Not every celebrity is an O.J. or Phil Spector. And the courts are not blinded by "stars"--if anything, they're more scrutinized by the courts--especially in England where Broderick's accident occurred.

81. Brandy has much money. Therefore everyone involved in the accident will heap extra blame on her. They want her money. That isn't to say that Brandy's driving was perfect leading up to the incident, but everyone will blame her regardless. They can't get any money out of anyone else in the situation.
