Michael Jackson Merchandise Hearing

8/17/2009 7:00 PM PDT BY TMZ STAFF

The lawyer for Michael Jackson's kids is set to appear in court for the first time today, as lawyers for the estate and Katherine Jackson's lawyers try to reach an agreement on merchandising all things Michael.

UPDATE 7:10 PM -- And we're done for the day. Biggest headline -- the judge has approved a major Jackson merchandising deal, but there is still one more deal (with AEG for a Jackson memorabilia tour) to be decided upon.

UPDATE 7:03 PM -- The judge has set an evidentiary hearing for Friday -- so the AEG deal won't be approved (or denied) until then.

UPDATE 6:45 PM -- An attorney for AEG says the company wants the deal taken care of this week.

UPDATE 6:41 PM -- And we're back on the record.

UPDATE 6:34 PM -- The judge has ordered a short recess in the hopes all sides can reach an agreement on the AEG deal today.

UPDATE 6:32 PM -- The lawyer representing Jackson's kids isn't sure the AEG deal is the best deal out there.

UPDATE 6:24 PM -- One of the lawyers for the special administrators is worried that if the AEG deal isn't approved soon, AEG will pull it off the table.

UPDATE 6:15 PM -- All parties involved continue to express the time constraint they are under -- everyone wants the deals done ASAP.

UPDATE 6:10 PM -- The attorney for the kids just said she is not objecting the AEG deal.

UPDATE 6:05 PM -- An attorney for Katherine just suggested the lawyers for estate have pulled the guardian ad litem towards their side.

UPDATE 5:58 PM -- The deal with Bravado, to produce various different kinds of Jackson memorabilia, has been approved. This deal will generate millions of dollars for the Jackson estate.

UPDATE 5:50 PM -- Howard Weitzman, the attorney for the special administrators, has stated that one of the beneficiaries approves the AEG deal (to put on a Jackson memorabilia tour), but one is against it. We've been hearing Katherine is not happy about the arrangement, so she is probably the one who has objected.

UPDATE 5:35 PM -- The judge has set a tentative date (September 9) to hear Katherine's safe harbor petition. What that means is that Katherine wants to file an objection to the special administrators, but doesn't want to do so if it would be considered protesting the will. Jackson's will contains a no-contest clause -- meaning anyone who challenges it loses their inheritance rights.

UPDATE 5:30 PM -- The judge said that if it weren't for Katherine Jackson's procedural posturing, both parties would not have to spend as much time in court.

UPDATE 5:13 PM -- The judge said he agrees with Lodise -- there needs to be a simpler process put in place so the special administrators of Jackson's estate don't have to go before the judge to do every single thing.

UPDATE 5:11 PM
-- The judge wants to come up with a trial date for Katherine Jackson's objection to the permanent appointment of the special administrators.

UPDATE 5:10 PM -- Margaret Lodise, the guardian ad litem for Jackson's kids, has submitted a report to the court.

UPDATE 4:57 PM -- The lawyers are getting into place.

UPDATE 4:47 PM -- Claire Elisabeth Fields Cruise, the woman who claims to be the bio mom of MJ's kids, is in the courtroom. Let the fun begin!

Ummm, typically an attorney does not appoint another executor to a person's estate. Are you referring to the Will/Trust being drawn by another firm attorney and Branca being appointed? MJ likely appointed both Branca and McClain himself... don't you think?

Or are you talking about Joel Katz' involvement (which at this point, I've not heard it is 'official'- but he'd be my guess at Katherine's seat at the table, since Jermaine likes him so well-- per LKL interview).

Be clear...the current executors of his will haven't made Michael $100 million since his death, the public has. WE are the ones buying his back catalog and anything "MJ" we can get our hands on, they are just reaping "good publicity" because of it.

I think Katherine Jackson seriously needs to back off and save her "objections" for the important stuff, or she will find herself holding an empty bag. If there is truly an ad terrorim clause in the will, I don't know how she can protest the executors named without nullifying her portion of the inheritance. The judge has been pretty reasonable thus far, so she needs to watch it.

83. Why are the executors so opposed to letting Katherine have a say in her son's matters? If everything their doing is ethical, then why not let her have a seat at the table? Katherine is not saying she wants to run his estate on her own, she just wants to be a part of managing it. What's the big deal with that?

C. = Keep in mind that before the estate gets a dime - the IRS has to be paid - and all the debtors have to have their claims settled - and the executors have to be paid - only then does the Trust get their funds - Katherine her 40% - the children their 40% and charities the other 20% - So it is in Katherines best interests to let the executors get as much as they can as quickly as they can for the estate - making deals like the Bravado one and the AEG one - before the Fans get tired of waiting and go on with their lives buying other artists -

It has always appeared that Michael was extremely close to his mother, the only person he felt he could whole heartedly trust, asides from his children. He sought advice from her, admired her, shared his thoughts with her and completely loved and took care of her. I would imagine she has solid reasonings behind her decisions and hesitations that are directly related to the intimate knowledge she has of her son's concerns. As well, I'm sure the lawyers on both sides are trying to twist her around. This is a senior citizen of our community that has lost a son and has yet to bury him and has been thrust into this circus of greed, corruption and urgency to exploit. Have some respect.

56. This may not be the right place, but I am sick and tired about how American people are arguing amongst themselves in such a bitter fashion.
Hi. To all you black people out there who claim MJ as your own, shame on you! To all you white people who claim MJ as your own, shame on you!

In case you never noticed Michael was an African American. So yes he is claimed as a black man and he stated he was a proud African American. So shame on you. Inform yourself.

Marv - We can have respect for the love Michael had for his mother - but it does not mean she is capable of running the empire that Michael built - She did not help him in any way to do that - his administrators did the deals for him for over 20 years so he obviously respected their advise -
His mother was just that - a Mom - a loved person in his life who he took care of - not the other way around and he meant her to be taken care of when he died too - BY HIS ADMINISTRATORS OF THE TRUST AND ESTATE!

BECAUSE THAT'S NOT WHAT MJ WANTED. WHY CAN'T SHE GO BY WHAT THE WILL STATES? BECAUSE SHE WON'T STOP UNTIL SHE GETS ALL THE MONEY..

What is Katherine's deal? Is she taking sidebar advice from Joe? What are they angling for? What the money for the children? what? I mean I know it's greed, but what else? Why a seat at the table. Is it just because they are on the outside looking in. Michael shut them out. He made her guardian of the children. Just not the money. She is about thisclose to making herself an outsider completely.
It has to be more than greed.

I think where Michael's death was concerned, this was supposed to be an open and shut drug overdose. Everyone would have collected the money and moved on. Here we are 2months later. Me thinks we are gonna be in court for years to come. And Katherine won't have a dime.
If Michael supported this family his entire life, they are still expecting that support now. Maybe that's the angle. I guess they can't live off Katherine's Social Security.

WONDERFUL POST.

51. This may not be the right place, but I am sick and tired about how American people are arguing amongst themselves in such a bitter fashion.
Hi. To all you black people out there who claim MJ as your own, shame on you! To all you white people who claim MJ as your own, shame on you!
We are talking about a man who wanted to destroy colour and race bars and make all people everywhere brothers and sisters.
How dare any of you talk about his children and the colour of their skin? Those children are MJ's lasting legacy. They loved their father and I pray to God that they are allowed to be proud of him and are able to give something back as he would have wanted.
You black and white people should hang your heads in shame because MJ was one amazing human being who would be appalled at these deep divisions. He would loathe all you people to be bigoted and unreasonable.
To all those on this website who make cruel jokes about this tragedy, I feel sorry for you. One day, someone dear to you who dies may be ridiculed in this way. How would you feel?
On August 9 biographer Ian Halperin reported in the Daily Mail that MJ's last hours were hell. MJ demanded the tour be called off and shouted constantly for his father Joe to be by his side and to "clean up the mess".
MJ was lied to and told his father could not be reached, so he ordered Murray to "put him out".
Just before this MJ had a shouting match on the phone with one of his advisors and MJ said he was calling off the tour.
I have always disliked Joe Jackson. I think him greedy and immoral, but he did tell his kids never to give less that 100 per cent and if not, not to perform.
However unpalatable it may be, I think MJ wanted Joe at the end. He forgave Joe long ago, he could not do the O2 gig and he wanted someone to sort it out.
I don't know if it is true but another report said MJ was so badly adicted a year ago that Joe wanted to section him and get him clean, but Katherine absolutely refused.
I always loved MJ's music, but I was a much bigger fan of the man. I am deeply saddened by the way his corpse is being picked over and the horrible comments being made about him and his children.
Can we not now let him " go quietly into that good night". We have lost someone very special and we should all reflect before making any further cruel or bigoted comments.
I am just an English grandmother, living in a tiny village in the middle of my beautiful country and I have black, brown, yellow and white friends. So you may ask, what would I know?
