Big Ben's Lawyers: Emails Shall Set Him Free

8/19/2009 2:00 PM PDT BY TMZ STAFF

Ben Roethlisberger's lawyers claim they have emails and IMs proving Andrea McNulty's sexual assault allegations are a load of bull -- including one IM she sent after the alleged incident saying, "I would date Ben Roethlisberger."

Alleged Andrea McNulty emails
Ben's attorney David Cornwell just released a document containing emails and IMs, which he says were sent between Andrea and her fake online boyfriend "Ben the Soldier."

In the docs, Cornwell says Andrea sent one "light-hearted" email to fake Ben around 12:41 AM on July 12, 2008 -- which would have occurred a mere 1.5 - 2 hours after she claims the real Ben assaulted her.

Cornwell says the email "proves that, rather than crying in her truck in the parking lot, and driving away, distraught and crying [which she claims in her lawsuit] McNulty was back at her workstation sending light-hearted emails and engaging in benign chatter with her online boyfriend.

Then, on the afternoon of July 12 -- one day after the alleged incident -- Cornwell claims McNulty wrote, "This golf tournament has been really fun ... speaking of which I need to head over to a dinner with your lookalike [referring to Ben Roethlisberger] and a few others before heading out..."

Ben's lawyers claim she sent another IM to fake Ben in December of '08, saying "I would date Ben Roethlisberger."

Cornwell attached a press release with the emails that included some advice for Andrea -- "McNulty should abandon her lawsuit immediately and admit that Ben Roethlisberger did not rape her."

I am a normal stable woman, and I can say 100% for sure that this chick is nuts! I'm sure she had a fling, and then got infatuated. After he didn't want anything to do with her - she got mad and obsessed and filed false charges. These emails show just how nutty she is. She talks about him like a stalker. Sicko....

Nice try, Ben's PI. Manufacture IMs to make your client look innocent and the accuser look like a nut. Only an idiot would buy this as proof. The accuser's attorney may well have a good case against this wife if she can't prove an ISP came from the accuser. Oops, jail time for the wife AND Ben R.

Yes I Have a Brain

Um, Betz ... only an idiot would think Ben's very well-known and highly qualified attorney would file these e-mails and IM's with the court without first backtracking the source, the ISP, etc. The accuser's own complaint acknowledged her relationship with the imaginary soldier. Another of her friends has already come forward in a sworn affidavit and testified that McNulty was hoping to get pregnant during her liason with Ben so she'd have a rich baby daddy. There's no big mystery here--it's an extortion scheme. And not a very good one. The people who still don't think so A) aren't reading the court filings and B) just don't like the Steelers. But it is what it is.

Oh, and Betz, since you're not up on the facts: Ben won't be going to jail no matter what happens. No criminal charges have been filed here. She's just going to court asking for money. Like I said: extortion. Plain and simple.

Me

This girl is a mental patient plain and simple, she has some serious issues! Like you are really gonna plan on going to WY with someone who supposedly raped you...OK LIAR! She is a disgrace to rape victims and women in general! For all those people who were so sure Ben was guilty, where you at now???!!! All he did was hit it and quit it and I'm sure he will do it again with some other skank(he'll just be more careful next time)just like all of you would if you were a professional athlete or some other kind of celebrity.

13. How about having her arrested after Ben wins this for filing a false police report.

Posted at 3:43PM on Aug 19th 2009 by Doc

There was no police report. That made this even more suspicious right from the start. Not only did she wait a year to file the civil claim, she never filed a criminal complaint. She just decided she wanted a payday and filed a lawsuit this year.

#7 Ben Roethlesberger isn't married. This wacko was having an affair with a married man. When his wife found out she established an email account for a "soldier in Iraq named Ben". She then started an online romance with McNulty. She finally pulled the plug by emailin "gotcha" to McNulty. McNulty fell to pieces. She confided this situation to several friends and co-workers. This is old news.

OMG! u people making comments need to read back into old TMZ about this situation. The girl (McNutty) was NOT emailing herself. McNutty had an affair with a married man (not Ben Roethlisberger). The married man's wife found out about the affair and made a fake email account for a fake soldier over seas. The wife corresponded with McNutty as if she were the fake soldier and McNutty fell in love. The wife says she did this so she could "impose the same heartache" on McNutty as she did her. So NO McNutty did not make up the account with his name and the fake email and person happened way before the Ben Roethlisberger situation.
