Michael JacksonSeveral witnesses expected to take the stand today as lawyers for Michael Jackson's estate -- as well as lawyers for Katherine Jackson and Michael's kids -- give testimony about the proposed deal with AEG about a Jackson memorabilia tour.

UPDATE 7:21 PM ET
-- The petition has been approved!!! The AEG deal is done, the memorabilia tour will happen. Finally. The three-city tour could earn as much as $6 million for the estate.

UPDATE 7:20 PM ET -- An attorney for Katherine wants more protections in the agreement to protect the estate and Michael's legacy.

UPDATE 7:14 PM ET -- The attorney for Michael's kids is in favor of the AEG deal.

UPDATE 7:07 PM ET -- And we're back!

UPDATE 5:50 PM ET -- The court has been closed again as one of the senior lawyers for AEG has taken the stand. Outside of court, Taj told reporters the family is more interested in protecting Michael's legacy than in making money. He also told Taj that he planned to do film after the London tour.

UPDATE 5:16 PM ET -- And we're back!!! Tito's son Taj is set to take the stand.

UPDATE 4:50 PM ET -- Court is back in session -- but still closed to the media. But it should be opened back up after the current witness is done.

UPDATE 3:20 PM ET -- John Branca has finished testifying via phone and they've adjourned for lunch. Testimony will begin again in about an hour -- but it is unclear whether the judge will re-open the court. Stay tuned.

UPDATE 1:51 PM ET -- Waiting patiently ...

UPDATE 1:26 PM ET -- The judge will re-open the courtroom after John Branca testifies via phone.

UPDATE 1:21 PM ET -- It happened -- the judge closed the courtroom.

UPDATE 1:15 PM ET -- Tito Jackson's oldest son Taj is in the courtroom.

UPDATE 1:10 PM ET -- The judge is considering closing the courtroom because confidential documents will be discussed.

UPDATE 1:06 PM ET -- AEG is upset because Leonard Rowe, who was expected to testify as an expert witness for Katherine, will not testify -- but he was shown confidential documents as part of disclosure. AEG's lawyers also say those docs have not been returned.

UPDATE 1:00 PM ET -- Change of plans already -- Randy Jackson will not be called as a witness, according to an attorney for the estate.

UPDATE 12:58 PM ET -- Lawyers for all sides -- AEG, the co-administrators, Katherine Jackson and Michael Jackson's kids -- are all in place.

Thank you FACINGREALITY. Is this CA law or is this applicable to all kinds of trusts? I don't think it is applicable to living trusts in some states which are created to avoid probate costs beneath a certain value of the estate. Is a family trust a subset of the different kinds of trusts in existence?

The trust was structured this way so it would be self-perpetuating without the principle being touched? Would the same be true for the children and charities?

Sorry for asking so many questions, but you and a couple of others sound like you know what you are talking about.

222....I believe the Jackson family's voices should be heard and at least considered since they're really left with no legal right to make decisions (which is fine as long as Michael is properly represented which, for the most part, he seems to be). I wouldn't want to be in their shoes, money or no money.

Marv - I believe MICHAEL JACKSON knew his family BETTER THAN ANYONE and if he wanted them to have a voice he would have stated so in his WILL. Doesn't it mark you as strange that his parents were not even aware of his having a WILL at the time of his death given the close relationship he is alleged to have had with Katherine. Could it be that he KNEW they would bug him to change it and/or include them if they had been aware of its content - given that they bugged him to the day he died for some type of financial assistance?

Michael's WILL should stand as it was stated and the Jacksons should (for the first time in their lives) honor his wishes. He KNEW THEM PERSONALLY and he did not name not a one to be on the Executors Board of his TRUST, nor did he name ANY OF THEM in the TRUST but his mother, children and charity. He was even smart enough to say that ALL MONIES REMAIN IN THE TRUST, ensuring that NONE OF HIS EXTENDED FAMILY got their grubby little hands on ANY OF HIS MONIES outside those named.

I have a question about confidentiality agreements. I know Michael required every employee to sign on before they went on the payroll.

At Neverland alone, he had 102 people working for him.

Do these ever expire? Especially if the person such as Michael dies ???

Could there be hundreds of books right around the corner?

214. I don't see how the memorabilia tour, if approved, would damage the legacy of Michael Jackson. Remember, one of the responsibilities of Team Branca is to protect the image and likeness of MJ and ensure it is authorized only in an appropriate maintain that maintains the image and legacy. I wouldn't go, but many MJ fans are salivating to see anything MJ related and the tour would be a sellout in the three cities that it would visit. The judge will decide...I think he will be glad to have this session over with.

My thoughts exactly. They want to protect his legacy, not to make money? Since when can't you have them both? It's not like the estate doesn't need money or can't gain money from this tour.
In fact they WANT MORE MONEY. KJ opposed the deal in the form of 50/50, because she&Joe hoped for a better offer from another company. (Maybe 90/10, like the Branca team secured for the movie hehe)

this is a joke. if the jacksons, espsecially katherine and/or joe have anyting to do with thie estate, the kids will be poor in less than a year. remember, katherine filed for bankruptcy not too long ago and only survived because michael supported her. joe is aa crook and i hope the judge sees the rats trying to steal michael's kids money.

Well, MJ's Sony/ATV is worth about 1.5 billion and Frank Delio got appointed to the board!!!!

Frank Delio is the follow the MONEY!!!!!

Also, I have read that Delio caused the problem with AllGood Entertainment which filed a $40 million lawsuit against MJ for fraud and violating a contract signed by Jackson’s manager.

According to the lawsuit, Frank DiLeo, Jackson’s manager and AEG the promoter of the event have breached the agreement as they have signed many concerts in London during the summer in which a pay-per-view event has also included.

One of the best things that has happened is that the judge appointed the guardian ad lithem(sp?) for oversight of the kids money. At least some parts of the judicial/probate system work well.

I wouldn't be surprised if the release of the DVD's after the two week movie stint provides AEG with a higher percentage than the 10% from the actual movie revenue. That seemed a bit low. I'm sure there must be some other means by which they have arranged to acquire additional revenue from the rehearsal footage.

Facing Reality - hmmm, good points. Having recently researched doing up a Will for myself (which, trust me, will be waaaaaay easier than Michael's! LOL!), it is advised to have someone outside the family to be an Executor who is well-versed in legal matters (i.e., lawyer, trust company, etc.) so it doesn't surprise me that any of his family members were excluded from that duty. As far as not knowing about his will, well, in my parents case, they have never asked, I have never told - I'm assuming they believe they will be long gone before I leave this world (I'm 50 years old) - and I am totally close to both of my parents. I'm also not 100% convinced that Michael thought his mother would contest the will, I doubt he thought she'd still be alive at the time of his death. It's all very convoluted, twisted and way out of my league. But it all makes for great speculation and wonder!

The lawsuit also says that AEG was aware of the contract between Jackson, Dileo and AllGood entertainment, but as they have power and dominance in live music performance industry which forced them to breach the contract with the entertainment firm and preferred to work with others.

If Michael gave Katherine a flat 40% she could distribute it however she wanted, willed that amount and could share it with Joe, I don't know the specifics of Michael's trust payout but I'm sure it was drafted as a standard payable trust and not a distributed will.

That confirms my suspicions as to why KJ wanted to either become sole executor or trustee of the estate. There was something in the trust that she didn't like and she wanted to change the terms.

Did you read the *Rolling Stone* article "Battle Over Jackson Estate Heats Up" about the acrimonious meeting Michael had with his father and Rowe in May, 2009? His mother was in attendance during the meeting as well, and she was the one who brought Rowe. Michael was so intimidated by being alone with his father in a hotel room that he stayed in his car until DiLeo and Randy Phillips arrived to join them. At any rate, *Rolling Stone* states it learned, "Joe Jackson, had made aggressive moves in the months before Michael’s death to take control of his son’s career and finances – and continues in spearhead an effort to change Michael’s will". Concerning present actions from the same article, "But Katherine’s lawyers are waging an aggressive effort to name her as co-executor – a move many believe to be Joe’s idea. 'They are trying to rewrite the will, trying to get control,'" DiLeo says.

Puts a spin on what's been going on with all of these court dates, doesn't it? That explains the ad litem, and the contentious relationship between the executors and KJ's lawyers.

FACINGREALITY Right on! I have devoured so much information about Michael these past two months and if one thing is crystal clear, he was sick and tired of being the cash cow for the family. I think he respected them, but I do not think he felt loved by or for them. There are too many instances of Michael distancing himself from his family and gaining confidence in people who seemed to genuinely care for him.
