Neverland Trademarks Don't Pan Out

9/11/2009 2:45 AM PDT BY TMZ STAFF

Efforts to turn Neverland Ranch into a tourist attraction just took one giant step backwards.

Neverland

We've learned Paul Fuhrman -- the senior vice president of Colony Capital -- filed paperwork on Wednesday asking the U.S. Patent Office to forget about the Neverland trademark applications his company filed last month. The request was granted that day.

Colony had filed the trademark applications in case Neverland was turned into a Graceland-esque tourist attraction for Jackson fans.

Doesn't look like that's going to happen any time soon.

This is just another blunder of Michael Jackson's legal misrepresentation. His attorneys should have had the trademark on Neverland done many, many years ago. Colony Capital knew they could potentially make millions of dollars by owning the Neverland trademark. The Jackson estate will have to buy the trademark in order to turn Neverland into a tourist attraction--it won't be cheap!

They don't have the right to do that. The news reported that the Patent Office contacted the estate. They were shut vdow. The greedy vultures. Showbiz411 reported this on Monday. Late!

Joe Jackson is illiterate

TMZ let us know the real reason these people changed their minds about the patents etc. Could it be that mongrel Joe Jackson wanted a share? I think it should be a tourist attraction...money to go to 'doctors without borders'or the Salvation Army. No money to Jacksons, Michael hated their ungrateful attitude also they didn't do enough to help him, only contributed to his demise. Joe J and Kathleen deliberately ignored the signals for help when he was an adolescent, because of $$$$. These Jacksons are hateful!

I've a hunch insiders are hearing thru the grapevine that some of the negative aspects of MJ's life are about to come out and that's why people are backing away from the tribute concert and Neverland plans. No one wants to be within 10 feet of it when it breaks.

The whole trademark issue was flawed from the start. Since Neverland first appeared in the book PETER PAN, it has been protected from other usage. Every instance where someone did NOT purchase the right to use the name for a certain high figure, they have been sued out of existence by the author's estate, who uses all proceeds from the book(s) to pay for the continued support of a children's hospital in the UK.

Joe Jackson is illiterate

TMZ what is the real reason why these people backed out of applying for the patents and turning Neverland into a tourist attraction? Could it be because the a*s ho*e Joe J wanted money? Someone needs to tell this semi illiterate prune that he has no say, MJ hated him for what he did to him during his childhood and adolescence. They need to run that place as an attraction and give Michael's share to "doctors without borders"or the Salvation Army. The ole ass Jacksons need to go get a job! Has any one in this family seen it fit to go to college?? They are not all talented. They are just despicable!!Kathleen is no better than Joe J, she stood by while her son somewhere during his childhood and adolescence went into a state of arrested development and did not seek help for him...they didn't want to interrupt the money flow; they are no better than Conrad Murray. Colony go ahead and make Neverland a tourist attraction so we can all visit! BTW did I tell you Latoya and Jermaine are money hungry too, no grieving for them!

Thank you GOD!!!

TMZ - please investigate the connection between Colony Capital and Jermaine Jackson.

I am convinced he's getting $$$$$$ from Tom barrack & Dr. Tohme.

Neverland was Michael's escape from the world. He never meant it to be this neo-Graceland. And after the trials, he never wanted anything to do with it again.

Why should he be there? Neverland is nevermore.

Then Jermaine pushing to have him buried there so Michael's remains could be some tourist attraction?

WTF? That's sacrilegious!

i come here today in total sadness of this whole tragic ending to a man who was loved and admired by so many!!!the love that he gave to others uncondionally will never fail, even if he is gone from us..it is so sad that there is no real news on his death and what they plan to do with dr murray,i find myself searching every tv channel even picking up stupid tabloid mag just to find some word on the investigation BUT NOTHING!!!! i read that the defense attorney is going for the case as dr murray was blackmailed by mj and he was going to shut down all of murrays funds that were going to get him out of debt--rent, child support, if he didnt give him the milk--etc... i just had to laugh, if that is all they have GOOD RIDDENS DOCTOR MURRAY ..it is so depressing that they have not kept the public at all up to date about what is going on.i also read that came in on my email alert that latoya had a taping with barbara walters and that she told her that michael looked so beautiful for the funeral that he was dressed in white pearls on his clothing and a gold belt as big as a championship belt that a wrestler would wear, she also said he wasnt GOD but he was GODLIKE in many ways!!!!.i am not sure when this interview will air..it seems that all they have to talk about these days concerning mj is negative things, but then again that is all they have ever done to this wonderul person that had a heart of gold for everyone in his life. janet will have a heart felt tibute to her brother that she truly loved and it will be wonderful to have her honor mj and she is going to carry this with her for the rest of her life.i pray for mjs children and hope everyday they can have the memories of him forever in there hearts as the true and loving father that they have ever known.jermaine is going to have to live with his guilt of being front and center of mjs business affairs that are indeed none of his concern, he was never there for mj in that sense, so he may be very much in denial of the fact that mj didnt want him to be apart of that in mjs life.it is all very sad that mj didnt have the family unit that alot of us have or would love to have,he stood alone all through his life and was left alone at the end!!!god rest your soul my friend and know you are a guardian angel for alot of us who truly loved you and what you stood for...sue from tampa

Neverland SHOULD be turned into a amusement park/museum/memorial place and underprivileged kids as well as the general public should be able to visit and enjoy Michael's dream.

Michael's vision for Neverland should be honored..he didn't do anything to those boys and he still was a part owner when he died. Maybe Michael wanted to reclaim Neverland someday after his comeback! Bringing Neverland back would be a tribute.

MICHAEL WILL CONTINUE TO HAVE BILLIONS OF DEDICATED FANS ALL OVER THE WORLD. THE NEXT GENERATION, AND THE NEXT, AND THE NEXT, AND SO ON, ARE GOING TO BE INTRODUCED TO HIS MUSIC AND ARE GOING TO LOVE HIM.

MICHAEL'S PRESENCE CANNOT JUST VANISH. WE WILL NEED SOMEWHERE TO GO TO HONOR HIS MEMORY AND BASK IN HIS GLORIES.

That place should be Neverland. My .02

Good luck on trying to file a copywrite on "Neverland" anyway...Disney beat them to it when Peter Pan came out. It never would have been granted.

People, NEVER LAND could NEVER be turned into a tourist attraction using that name...don't you get it?!!! That name was copywrited or Trademarked...all they can do is get permission from Disney (you know Peter Pan) to USE the name if they turn it into a business, which a museum...is an attraction...hence a business. So they had to drop the action to try to trademark it. It's not like "Graceland" which was a unique business name at the time it was turned into a museum.
