Larry Birkhead is on the stand in the preliminary hearing involving Anna Nicole Smith and the defendants who allegedly fueled her drug habit.
Birkhead just testified between August 2004 and May 2006, he saw Anna take the following drugs regularly: Topamax, Lasix, Klonopin, Valium, Xanax, Potassium and Methadone.
He has not talked about whether Howard K. Stern or the two other defendants -- Sandeep Kapoor and Kristine Eroshevich -- helped facilitate Anna's drug use, but he did identify Dr. Kapoor as Smith's regular physician at the time.
UPDATE 3:20 PM ET -- Birkhead testified he saw Anna's prescription bottles with several different names on them: Anna Nicole Smith, Michelle Chase, Vicki Marshall and Jane Brown. Larry also said the whole time he knew Anna he was concerned that she would take her meds inappropriately.
UPDATE 5:50 PM ET -- Birkhead testified he never saw anyone force Anna to take medication. He said he saw Anna with a duffel bag full of meds. Birkhead said he saw Stern give the bag to Anna Nicole, but didn't see him administer any drugs.

I think I got it now! PROCURING --setting up a phone consultation with the poison control guy at UCLA. Must be worth three felonies. Dr. K 'conspired' with Dr. E (even though he didn't know her) by forwarding her fax to Freeman while somebody else conspired to sell the fax to TMZ! Yes, that's it. The hospital may prescribe and dose ANS with methadone as a treatment during pregnancy--but NOT Dr. K? A couple of felonies right there.

"Earlier in the day, the defense asked to remove a member of the prosecution team, Sarah Slice, who had been accused of trying to influence the testimony of witness Larry Birkhead.
Without comment, the judge declined to order her removal.
District attorney's spokeswoman Sandi Gibbons said Slice was no longer functioning as a deputy district attorney on the case and was returned to her previous role as a law clerk for this case only.
Slice had been in charge of organizing files for the hearing and "to lose her now would be detrimental," Gibbons said.
After the hearing, Slice will return to duty as a deputy district attorney elsewhere in the county, said Gibbons, who declined to comment on any contacts between Slice and Birkhead because it was a personnel matter."

That is BS. Like it is not DETRIMENTAL that these Defendants' lives are at stake with the prosecution influencing witnesses!! Their whole case is only helping the Defense and they are desperate. The fact that she will return to her former position after this case is only showing others that the gov't finds nothing wrong with this type of behavior & most likely condones it.

196. Testimony about heating drugs to inject is false
Prescription drugs in tablet form contain a tiny amount of the actual drug but a lot of filler materials. Grinding a pill into powder and âheatingâ it, does not provide an âinjectableâ form of the active medication.
Filler materials can be dissolved in water to precipitate the active drug that is rarely water soluble. Isolating and âsuspendingâ the active drug in a safe injectable medium (not plain water) is a time consuming process. Most homes have the substances and filters to do this process, but it takes a great deal of time.
Anyone testifying that someone crushed pills and heated it in a spoon to inject is lying. Someone crushing Valium as an example to inject would be missing in action in the bathroom for hours.

Yes with a whole lot of chemical smells flowing through the home. This is such a good example of the lies told throughout, easily disproved with a small amount of research. It has amazed me, although obviously desperation, that no one thinks of these type of things when coming up with the lies??

What was the Feb. 2009 ATF/DOJ raid about and what happened from Oct. 2007 until Feb. 2009 as to 'new' evidence they found? The only thing 'new' was adding Howard to the charges.
Also, why would you think that a judge presiding over a preliminary hearing would care anything about the defense at this point? Other that to shut down the death in Florida AFTER Santiago testified all day about something he never participated in insofar as the investigation--everyone knows the prelims are to slide through on to trial. That's all the judge is there to do--send it to trial. This is the first time I have even seen one or two defense witnesses at a prelim.
The only thing standing between justice and the chutzpah of lousy prosecutors with a lousy case is THE JURY. That is our jury system and it is THEIR job to weigh the facts. Judges at trial only 'referee' the proceeding as to admissibility of evidence, etc.

LOS ANGELES (AP) -- Investigators are testifying about prescription and travel records of two defendants in a drug case involving Anna Nicole Smith.
An agent from the Department of Homeland Security testified Friday in Los Angeles that there were many trips made by Dr. Khristine Eroshevich to the Bahamas while the former Playboy model lived there.
Another agent from the California Department of Justice pharmaceuticals task force identified records from several pharmacies detailing drugs issued to Smith's boyfriend Howard K. Stern.
The dates of the prescriptions often coincided with the trips Stern took to visit Smith.
The testimony came at a preliminary hearing to determine if Stern, Eroshevich and Dr. Sandeep Kapoor should stand trial on charges of illegally providing Smith with controlled substances.
Smith died of an accidental drug overdose at a Florida hotel in 2007.

Agreed. It is strange that Cutliff was usually the driver for O'Quinn, and yet this time he was not driving. Neither wore seatbelts. Makes me wonder if O'Quinn was angry if he forgot something or just plain in too much of a hurry? No matter the actions of any person in life -- what a sad way to have it end. I feel sorry for each of their families and am glad no other car with people was involved in this crash. It is hard for me to call it an accident when someone is going that far over the speed limit.
I'm anxious to see who starts *spilling* the truth out in the SC case.
A little lost on how it would be decided for recovery of Estate losses.
Will FS and people who took ANS's property like their attorney be criminally charged by distributing it to Fox News or the LE in CA?
