Larry Birkhead is on the stand in the preliminary hearing involving Anna Nicole Smith and the defendants who allegedly fueled her drug habit.
Birkhead just testified between August 2004 and May 2006, he saw Anna take the following drugs regularly: Topamax, Lasix, Klonopin, Valium, Xanax, Potassium and Methadone.
He has not talked about whether Howard K. Stern or the two other defendants -- Sandeep Kapoor and Kristine Eroshevich -- helped facilitate Anna's drug use, but he did identify Dr. Kapoor as Smith's regular physician at the time.
UPDATE 3:20 PM ET -- Birkhead testified he saw Anna's prescription bottles with several different names on them: Anna Nicole Smith, Michelle Chase, Vicki Marshall and Jane Brown. Larry also said the whole time he knew Anna he was concerned that she would take her meds inappropriately.
UPDATE 5:50 PM ET -- Birkhead testified he never saw anyone force Anna to take medication. He said he saw Anna with a duffel bag full of meds. Birkhead said he saw Stern give the bag to Anna Nicole, but didn't see him administer any drugs.

I also don't believe brickhead's story she blew off a visitation.

I honestly donât mean to be rude when I say this. But how many times does this have to be said??..
After the DNA test proved that Larry was DLâs real father the only thing that stopped Larry from taking DL home and AWAY from Howard was that he had to change DLâs last name and get her a passport. That was it. But then Virgie delayed Larry from taking DL home even longer by suddenly trying to fight him for custody. (Donât you remember Larry saying something like, âI have parents to and they arenât fighting me for custody,.â ) The delay caused DL to stay with Howard longer. It seems like there are fifty million different cases going on in this saga but do you really not think that that isnât gonna come up in at least one of them??

All sarcasm aside, when did VA say that?? (maybe I just missed it- or donât remember it) I donât know if its true or not, but as far as I know VA has never actually held DL.
You obviously know about that time when Howard would not let VA touch DL. I could be wrong but as far as I know she has had no other chances (Mainly thanks to her own doing)

If I remember correctly the court ordered HKS to let VA come to Horizons and see DL. That is the time Howard would not let VA wake her up. Then the court let VA meet DL in a lawyer's office, where VA promptly went on Greta or NG and said she gave her (DL) "sugar kisses on her neck"
The BIG DEAL was a day or two later another meeting for VA to see DL at a neutral place - court hadn't been going her way. LB would bite at TX offers - BOTTOM LINE, VA didn't show up and did not cancel.
LB told the world this, VA never denied it and that is the whole truth of it! LB NEVER had a deal with HKS, the only deal offered to LB was by TX and LB refused (as he should have) that is why TX WAS out to get them both, well that and the possibility of the Marshall estate. The Marshall's and their lawyer Rusty were O'Q's friends, that is not the case anymore.
VA said she is never going to stop, well then she is going to have to pay for her meddling now. Bet is she will not spend a penny of her own money or the money she made of selling precious pictures of DWS when he was a young lad. DEATH MONEY for her lipo no doubt!

I described each of 13 days of a prelim and how the prosecution had no case. Maybe you are confusing 'should not' with 'would not'. The prosecution has no case, never had a case, and won't have a case in the future.
Moreover, McCabe has failed to respond to anybodyâs answers to the original petition (notably TMZ, HKS and LB). HKS and LB are not deemed defendants yet. Bonnie accepted a default rather than comply with Lindsayâs unlawful order for production. VA and her henchmen have not been handed over for depositions. Sloppy, sloppy, sloppy.

Why keep bringing it up about virgie? She has never filed in any court to have grandparents' visitation. Like she could have done with Daniel up until he was 18 years old.
Looks like only one or two of the texas bloggers for mccabe and gang are the only ones that keep harping on virgie seeing DL, when even virgie herself could care less. If she did, she wouldn't have sued LB for a made-up lie that he defamed her or conspired to defame her.
It has never been about seeing any of her grandchildren from Anna, it is what can she get from them thru the Marshall estate. Facts are clear, the first thing virgie went on television and said after Daniel died was that the old man Marshall left him a trust fund. He didn't and if he did she had no business with it anyway, she did not go out of her way to see the boy in over a decade. She has ruined any chance of ever touching DL or seeing her again in the future. No Judge would force an estranged grandparent that serves him papers in the hospital, who has texas minions try to get him to "DEAL" with them, who brings him into lawsuits based on lies -- the Judge, any Judge would not make LB give a person like this any time with that little girl. DL's only single parent and sole guardian cannot be forced by the justice system to let a vengeful acting person intent to clearly do him harm into his child's life.
No sense in even bringing it up anymore, it's never going to happen. Those were also Anna's wishes, she didn't want these people around her or her children. No more to say about it, it is done and finished.

I can't see the amount of money needed to continue the bloggers case charade much less any other law firm waiting to take on such a lawless controversial case. Hopefully , all things HC and VA will come to an end. The great worry would be those filing claims against said estate.Not sure of HKS ever collecting any fees from hos defamation case and their are many outstanding claims( breast litigants ) against the estate.
Well, Iâve always seen this âbloggersâ case as a data-mining operation meant to harass and impoverish people along the way as more false witness or more false evidence was âdevelopedâ against HKS and LB. Itâs never been a legitimate suit that any other usual and customary lawyer would have contemplated.
I would expect OâQâs Executor is the one who would order the dismissal of this disgraceful case; the same person tasked with letting go and providing severance to mere employees like Clark and McCabe. I would also expect a dismissal with everyone assuming their own costs would be proposed; otherwise severely damaged people like LH, TS and Bonnie would be thrown into Harris County Probate and have to argue damages against the Estate and against all odds.
The costs of the 1st COA and the TSC continue to accrue as long as the trial court case remains on the books. Itâs likely too much to hope that the 80th Court would award even Attorney fees since that would require a âbad faithâ finding against VAâs people. Judge Lindsay propelled the case forward; that pretty much negates the argument of âbad faithâ on the part of VA/McCabe.
