The case is truly dead, no other lawyer will buy up a losing case and *absorb the over half a million that was spent* on it. The Marshall's do not have any other rich friends like O'Q to throw their money away and use it as a write off on taxes.

528. Minor Update on SC case from today:

Docket Text: NOTICE of Cancellation of Hearing: In Camera Hearing on Motion [69] First MOTION to Withdraw as Attorney In Camera - Susan M. Brown, MOTION for Hearing, [68] First MOTION to Withdraw as Attorney In Camera Motion Hearing set for 11/3/2009 11:00 AM HAS BEEN CANCELLED.

Poor SB with no one to back her up anymore.

• SB tries again to be removed as counsel for G. Ben

To continue the update; the day after the above Hearing was cancelled; SB had G. Ben sign an affidavit for the Court. G. Ben declared that due to a ‘conflict’ becoming apparent with his continued representation by SB and Joye (SB was pro hac vice with the sponsorship of SC lawyer Joye) he asked that the Court allow both to withdraw as his counsel of record in the SC case. The ‘conflict’ was of course that SB was added as a defendant in the SC case. On 11-5-09 SB and Joye filed a joint Motion as Doc 82 with the attached affidavit of G. Ben. SB and Joye had separately filed Motions 9-30-09 to be relieved as counsel and asking for a hearing in camera to discuss the matter – without explanation or supporting materials.

What happened in between 9-30-09 and the cancellation of the hearing 11-3-09? SB was finally brought to a depo 10-5-09 (after asking the Court in SC 10-2-09 to stay her depo ordered by the N. GA Court which the SC Court denied the same day) and HKS filed a first Motion for sanctions against SB and G. Ben 10-28-09.

Recall, SB was found to be holding electronic and printed materials in her Office at the time of her depo that were copies of the stolen items from ‘Horizons’. That was in continued defiance of the SC Court as was the case when SB refused for months to hand over the USB drives containing all the files from ANS’s computer that she had ‘shared’ with the O’Q Law Firm.

What ever will happen with SB?

Have you read J.M.O'Q's will? What other law firm will buy this no money maker case and spend millions?, or please point out in his will that this case is funded. Put up or shut up empty head, He wanted in the event of his death to not have any cases go forward that could not be sold, He obviously didn't trust his own employees with his name, Shyster is as shyster does, He even shystered his own employees, High five O'Q!, can't fix shyster. Isn't it funny that here we are years later and EVERYTHING we wished for HAS IN FACT COME TRUE ! HS is going to trial for the role he played in the deaths of ANNA NICOLE SMITH AND DANIEL her son. It shows the greatness of our legal system, though for some who have inserted themselves in this story, it is not so great news.

For the rest of the world who witnessed the outrage done it sounds like music to our ears. That the three will in fact answer to his/her HONOR for their actions . A jury will decide the accused fates. This as it should be. HS will attempt to blame the Dr.s for HIS ACTIONS but will fail in his attempt. HS ISN't a DOCTOR but he played one in REAL TIME>

Update on McCabe’s Hail Mary Pass – the silly Rule 91 ‘Special Exceptions’

Rather than the required “… exception shall not only point out the particular pleading excepted to, but it shall also point out intelligibly and with particularity the defect, omission, obscurity, duplicity, generality, or other insufficiency in the allegations in the pleading excepted to.” McCabe claims he needs the Court to order CBS to explain what it means when referring to the media storm surrounding the ANS saga. Huh? VA and O’Q were media-whoring with a fury and yet McCabe doesn’t know what CBS means when it refers to same in its answer; a preposterous delay tactic.

Then on to TMZ’s Answer from 18 months ago and McCabe claiming to need to know what a ‘qualified privilege’ is. Well, people who have information and share it with others are not guilty of telling lies if what they knew at one time turns out to be only partially or not at all true later if the sharing of information in the first place eventually leads to the truth coming out. News Agencies constantly publish false information during breaking stories because that is the nature of reporting; you go with what you have when you have it. Any quibbles with the real or perceived content of TMZ’s stepbrother story at one time are cured by the passage of time and corroboration of the underlying facts = the ‘qualified privilege’ that TMZ noted. Or as McCabe was forced to admit during a hearing for the ‘Mommie Dearest’ Federal case, the TMZ story is “substantially if not literally true.”

McCabe and VA at it again - McCabe wants an order for production by CBS for audio/videotapes, emails and docs that pertain to it and all of the other defendants in the phony ‘bloggers’ case.

FAT CHANCE – no prima facie showing by VA as required by the real law for such a motion, motion for final summary judgement already righteously submitted to the Court by CBS and, oh, 4 Writs of Mandamus pending relating to the same nonsense caused by Lindsay unlawfully ordering same against HKS, AH and TS.
