Joe Jackson Shut Down

The judge in the Michael Jackson estate case just put a quick stop to Joe Jackson's objections to the will and to the executors -- in a nutshell, the judge said Joe had no dog in the fight ... no legal standing.

The judge indicated the way is now cleared to formally appoint John Branca and John McClain co-executors of Jackson's estate.

Joe's best bet is to file for legal separation and request support, or divorce and request alimony. That would be factored on Katherine's income, and he probably would get more than he's been accustomed to lately (just as Katherine is), but certainly not the exorbitant budget he was requesting for an allowance! I said that last Sat. too, on the other thread, but it is all common sense any estate-wise attorney would know.

If Joe tries to file any creditor's claim, I think they will try to say that there was some sort of "implied" contract between him and MJ, and not any written, signed contract. Either way, it smells like bologna.

That might be true in some states when you are referring to natural heirs, but, in this case Michael's natural heirs were his children. (If no children, it reverts back to parents, and if no parents, then siblings for intestate succession, when there is no will.)

However, neither Joe nor Katherine would have inherited anything if not for MJ's will. The kids would have gotten it all in equal shares (now, if a specific child was being deliberately disinherited, it would be best to state that in the will to avoid a contest, thought that does not mean the contestant would necessarily prevail).

So, MJ had no reason to specifically mention that he was deliberately leaving Joe out of the trust which sprung from the will.

I do agree that Joe could create a problem for Katherine if he filed for divorce and asked for alimony from her because she now has a much larger source of income than he does. (Although inherited assets remain separate from marital assets in many states, as long as the inherited assets are not "co-mingled" with the marital assets at any point.)

It does not appear that Katherine will have to give any kind of accounting for the 40 percent of trust income she will be receiving once the estate is settled, and can give whatever she wants of that to whoever she wants as long as she is alive.

Anyway, it is really an outrageous long shot for Joe to expect to get any support directly from the estate when he is not a named beneficiary, and would not have been a natural beneficiary of MJ's estate in the first place. If Katherine had not been specifically named as a beneficiary, or if there had been no valid will, then neither her nor Joe would have a valid claim for support from the estate at all unless they were a creditor and were making a creditor's claim.

809. I hope they don't give Joe Jackson one thin dime. I don't know what the law is in California, but where I live to exclude someone from your will you have to state something like "I leave my son, John, the sum of one dollar" and have a no contest clause. Maybe Joe can contest it because he was not specifically mentioned? Any lawyers here? Then again, Michael had a no contest clause so anyone who contested the will was immediately out. I would assume, don't know for sure, that that would put the kabosh on Joe Jackson trying to get money from the estate. Anyone?

Oh thank God the judge didn't let this circus continue to waste time! I cannot believe Joe Jackson...Michael didn't leave him any money, so that means he doesn't get any money!! I'm one. It depends on whether Oxman ever represented MJ in any contracts and events, etc., relating to this estate dispute. Unrelated representation probably would not be a conflict of interest. To my knowledge, Oxman was not involved in MJ's estate planning, but rather Branca's firm.
