Fetus-Killing Powder Suspected in Brutal Murder

fetus killerCops believe they now know how a famous L.A. restaurateur allegedly murdered his unborn child -- and it all has to do with a deadly white powder.

TMZ has obtained the search warrant affidavit in the investigation of Josh Woodward -- co-owner of L.A.'s 8 Oz. Burger Bar and several famous restaurants around the country.

In the docs, Woodward's baby mama says one night back in October -- when she was pregnant -- Woodward kept putting his hand in a plastic bag and then touching her sexually.

The woman says she lost the baby a few hours later ... and remembers seeing a white powdery substance on her underwear.

According to the affidavit, cops had reason to believe the powder was a drug called Misoprostol -- which is often used for early abortions and to induce labor. Cops then executed the warrant and set up a sting operation.

Now get this: Under police supervision, the woman called Woodward -- who did not know she had lost the baby -- and told him she was still pregnant and wanted him to come over.

According to the affidavit, when police approached Woodward outside of her apartment, he pulled out a "small piece of clear plastic with a white powdery substance" from his pocket and dropped it on the ground.

Police seized the substance -- which Woodward would not identify -- and arrested him. Cops are waiting on the test results of the substance, but believe it's Misoprostol. Woodward has yet to be charged with a crime.

Finally the more intelligent posters came out on TMZ today. After all the Prejeaners and Jakaloonies, it's great to see some thinking humans here today.

This case could be dicey. What stage of pregnancy was the woman in? The law generally will only prosecute someone for murdering of a fetus only if the fetus is "viable," e.g. able to live on its own, as in Lacie Peterson's case. This means the woman would have had to be in her third trimester.

While this guy is about as vile as a human being gets, it's dubious whether he's prosecutable for murder, as this was a fetus, not an infant. Last time I checked, aborting a fetus all the way to the end of the second trimester was legal, but killing an infant was undoubtedly murder.

Unfortunately, he may only get prosecuted for use of an illegal substance, IF that drug was illegal in his state, assault and battery and ?? Let's hope the prosecutors in this case are really savvy and creative in taking this POS down.

My wife,son and I eat at 8 oz all the time since he was 4 months and there are no high chairs in the place, we asked the manager if it was possible to get a high chair for our son and the answer was " the owner doesn't want any kids around". I guess she wasn't kidding.

Just so we're clear, if the mother doesn't want to be pregnant anymore, it's a "fetus" being "aborted"; if the father doesn't want the mother to be pregnant anymore, it's an "unborn child" being "murdered"? God bless America.

Oh god, the crazies are coming out for this one. It isn't the same as abortion, she was not given the right to choose. If he didn't want a child, he should have kept his wiener in his pants. With that said, when the baby was born he could have given up parental rights and paid child support and sucked it up. I am sure as a famous restaurateur, he would have no problem paying support.

I don't see how this woman could sit there and let this man finger her with white powder. Something is just not right here.

Evil jerk. He should rot in jail for life... but sadly, I wonder what they can charge him with? Probably going to be some sort of aggravated assault... or even practicing medicine without a license. If they charge him with murder, then that opens the door for physicians and other health care workers to be charged with murder who perform abortions.

My condolences to the Mom. And TMZ, you shouldn't tell what the powder is, and how he did it... too much risk of a copycat following suit.

I take the Pontious Pilot point of view, where I wash my hands of the sin, but give the people the choice. Since it is ok for women to abort a fetus, men should have a choice to not be a father. Maybe put this substance on a brand of condum and verify the health affects on humans before going commercial though.

Even though I am quite anti-abortion, I do have to say that this is an absolutely ridiculous double-standard. Why is it not murder when a woman aborts a fetus against the father's wishes, but this man is a "murderer" for causing this mother to have a miscarriage against her wishes? Some fathers actually WANT their babies but can't do a single thing about it if the mother decides to abort, and that's just as wrong but no woman is ever arrested for it, much less brought up on murder charges. If you pro-choicers agree with a woman's right to abort a fetus against a father's wishes, then don't bother crying "murder" here--at least be consistent with your beliefs. This man IS a murderer, but given that abortion is LEGALIZED murder (thanks to you pro-choicers), he should not be punished by a court of law for anything other than what he did to the WOMAN. If mothers should have the right to choose to abort a fetus, so should the fathers--if mothers should have the right to protect their fetuses from abortion, so should the fathers. It's incomprehensible that a fetus is only a human life for as long as the mother deems it so and can lose their status as being considered human life as soon as the mother changes her mind and wants an abortion. Why should mothers have so much power as to decide what is and what is not HUMAN? Shouldn't such a thing be determined by LAW, and not by individual choice (especially given the idiocy of so many people nowadays)?

And don't even start with the "it's the woman's body so it's her choice" crap because the FETUS' body is not HER body, and no one should have the right to harm or destroy a body which is NOT their OWN. If she didn't want to be pregnant, then she should have thought about her body and her choice BEFORE she got pregnant and kept her damn legs closed. It's truly unfortunate for victims of rape and my heart goes out to them, but if someone perpetuated an act of violence on you, why would you turn around and perpetuate another act of violence on someone else, especially an innocent being? Babies don't ask to be conceived but damn if they're not the ones who pay for everyone else's mistakes!

And yes, I happen to be a woman myself.

Clever. If he'd been more discreet he could have gotten away with stopping a potential gold-digger by killing of the spawn/pawn she was carrying. He should have incapacitated her first. Next time, wouldn't it just be easier to use a condom though?
