Fetus-Killing Powder Suspected in Brutal Murder

11/17/2009 3:00 AM PST BY TMZ STAFF

fetus killerCops believe they now know how a famous L.A. restaurateur allegedly murdered his unborn child -- and it all has to do with a deadly white powder.

TMZ has obtained the search warrant affidavit in the investigation of Josh Woodward -- co-owner of L.A.'s 8 Oz. Burger Bar and several famous restaurants around the country.

In the docs, Woodward's baby mama says one night back in October -- when she was pregnant -- Woodward kept putting his hand in a plastic bag and then touching her sexually.

The woman says she lost the baby a few hours later ... and remembers seeing a white powdery substance on her underwear.

According to the affidavit, cops had reason to believe the powder was a drug called Misoprostol -- which is often used for early abortions and to induce labor. Cops then executed the warrant and set up a sting operation.

Now get this: Under police supervision, the woman called Woodward -- who did not know she had lost the baby -- and told him she was still pregnant and wanted him to come over.

According to the affidavit, when police approached Woodward outside of her apartment, he pulled out a "small piece of clear plastic with a white powdery substance" from his pocket and dropped it on the ground.

Police seized the substance -- which Woodward would not identify -- and arrested him. Cops are waiting on the test results of the substance, but believe it's Misoprostol. Woodward has yet to be charged with a crime.

gossipsucks

Your facts are wrong. They all showed up to court.

That said, if he ends up being charged with the crime - and convicted - he deserves to be locked away for life, or worse. No argument here. Nor, (I hope) from the others who you wrongly accuse of being "on the payroll" - an absurd accusation...

For the moment, he has a RIGHT to the benefit of the doubt.

Josh*is*guilty

Listen here gossipsucks...He did it and thats the bottom line. Unlike you, I actually know what happened. There was no court appearance and none of this mushy "we stick by our friend kind of crap". He was in jail for a few days and then was sent home to await his next arrest. Thats it, plain and simple. He murdered his baby and could have killed the babies mother and now he is going to pay. The only reason he is a free man is because the state is smart enough to wait for all the test results to come back, so they can throw him the book. I strongly urge you to stay away from him because Josh is exactly what he is acused of, "A BABY KILLER"! Are you that soul less? Have you ever even thought for one second about this babies mother? The fact that she will never be able to trust a man again? The fact that he manipulated her and took advantage of her when she was most vulnerable? The fact that her heart is broken into a million pieces? Did you ever think that maybe she actually loved Josh and thought that they were going to be having a beautiful baby together? One thing I know for sure is that she loved her baby and because of him, her baby is dead! This is awful and I cant believe that he still has people supporting him? Nothing can worse than killing your own baby! I totally get the whole "innocent until proven guilty" thing, but consider this warning as my holiday gift to you. Josh is Guilty and wont be around much longer to feed you his lies and bullcrap. Enjoy the time you have left with him because pretty soon you will be talking to him through bullet proof glass. I hope Josh likes it from behind because rich white boys dont have much of a say in prison. They are told to "shut and bend over"!! Sounds like Josh will be getting exactly what he deserves!

this message is for gossipsucks.

did you know most criminal's friends, family and neibors say they can't believe it, he is such a kind person.

this whole case is a horible nightmare for alot of people!

because of his selfish actions his family could lose a son, brother etc to prison if convicted. his business partners could lose business even though they are not being accused. nobody wins in this situation, convicted or not. the mother will be scared for life. there was a whole lot of people looking forward to this BABY
coming into this world it's a shame that there was ONE that was not.

in time all the evidence will come out and justice will be served.

he could have walked away and been a dead beat dad.

Kathy

I heard about this on the news for the first time last night and I am shocked and saddened. I don't know any firsthand details of the event but I pray that Josh will get a fair shake. I'm 60 years old and have known Josh since he was seven years old. All I can say is that there has got to be more to this story. The Josh I know wouldn't dream of committing such an unconscionable act. He is exceptionally bright, kind, compassionate, and loving. He is generous to a fault. I suspect the so called "baby mama"shares more responsibility for this terrible situation than we have been led to believe. Don't misunderstand me. IF Josh is guilty of using Misoprostol to cause the miscarriage without her knowledge, no matter the reason, it is a terrible thing. She has been violated in the worst way and I have great compassion for her loss. I am deeply saddened if it is true that Josh chose to take such reckless action - regardless of the cir***stances. He should and will have to face the consequences of his actions. However, this would not be the first case of a woman tricking a wealthy man into fatherhood for an 18 year meal ticket! I AM NOT SAYING THAT'S WHAT HAPPENED HERE. I AM NOT ACCUSING THE BABY MAMA - NOR AM I EXCUSING JOSH'S BEHAVIOR. I don't know her or anything about her. I'm only suggesting that there is much more to this story for Josh to resort to such an unthinkable and desperate act.
